2) The granting of the Variance would constitute a grant special privilege <br />with respect to properties in the same neighborhood and zone. A Variance <br />would increase housing density on a lot which meets the requirements for a <br />single family residence, but not for a duplex. Variances for both size and <br />width have not been allowed in this residential district. There are other <br />properties in the neighborhood with two units on lots with the same size and <br />width as that at 3017 Hoover Street. However, these duplex units were built <br />prior to August 21, 1977 when the minimum lot size requirement for duplexes <br />was increased from 6,000 square feet to 7,500 square feet, and the minimum <br />lot width requirement was increased from 50 feet to 60 feet. <br />3) The granting of the Variance would be contrary to the intent of the <br />Zoning Ordinance. The intent of the Zoning Ordinance is to prohibit an <br />increase in density leading to increased traffic and increased water and <br />sewer use unless the lot is sufficiently large enough to accommodate a second <br />dwelling unit." <br />Carried by unanimous roll call vote. <br />MINUTE ORDER NO. 90 -143 <br />--------------------------------------------------------------------------- - - - - -- <br />2. Affidavits of Publication & mailing <br />are on file in the City Clerk Department. <br />Location - 34 Central Avenue; being Lot 9; Roussel Subdivision; APN <br />059 - 994 -030; "R -2" (Residential Duplex) District. <br />Report: Planning Director, 9/24/90 <br />Planning Director Patterson presented the staff report. <br />Mayor La Berge declared the Public Hearing open at 8:16 p.m. and invited <br />anyone who wished to speak to please do so. <br />Steve Simpson, designer, 703 Woodside Road, representing Mr. and Mrs. Musso <br />advised Council the question to be considered is use of the property from <br />single family to a duplex; the special circumstances include the four <br />duplexes on the same block including the one adjacent to the property, the <br />commercial building on the other side of the property and the proximity to <br />Woodside Road; the property is highly impacted by commercial surroundings and <br />the Mussos have no control over use of those properties; no special privilege <br />would be granted as there are three other non - conforming duplexes on the <br />block; the easement should be treated as open space since nothing can be <br />built on it; the proposal would be consistent with the General Plan as area <br />is zoned R -2; additional unit would not overload the sewer system as <br />suggested; and neighbors support the proposal; and the second unit would be <br />used for family members.
