3. PUBLIC HEARING - Master Cable TV Franchise Agreement (1201 -04) <br />Affidavit of Notice of Hearing publication on file. <br />Report: City Manager, 9/25/90 <br />Assistant Finance Director Ponty presented the staff report and in response <br />to Council questions advised that federal law prohibits the City from <br />establishing rates or determining which channels will be made available; <br />described agreement for service upgrades and increased responsiveness; and, <br />advised that the final negotiated agreement between Redwood City, San <br />Carlos, Belmont, San Mateo, Brisbane, San Mateo County and TCI, Inc. <br />includes the Joint Powers Agreement, San Mateo County Cable Television <br />Authority (SAMCAT). <br />Mayor La Berge advised that San Carlos City Manager Mike Garvey today <br />received a letter from TCI, Inc. asking for a few minor changes to the JPA <br />agreement, and therefore the pubic hearing would be opened tonight and <br />continued open to November 5, 1990 to allow for fine tuning of the proposed <br />agreement. <br />MEMO 10/16/90 <br />Mayor La Berge declared the public hearing open at 8:02 p.m. and invited <br />anyone who wished to speak to please do so. <br />The following people addressed the Council: <br />Ralph Nobles, 3720 Country Club Drive, advised Council TCI, Inc. had been <br />slow to respond in the past, and appealed to TCI, Inc. to add Channels <br />54, C -Span and Cal -Span if capacity is increased under new franchise <br />agreement. <br />Christopher Schmidt, 911 Fulton Street, spoke in opposition to granting the <br />franchise to TCI, Inc. as they are non - responsive and do not offer <br />channels the public wants, such as Channels 54 and 32. <br />John Humphreys, 25 Hilary Lane, requested TCI, Inc. to offer greater variety <br />including Channel 54. <br />Nita Spangler, 970 Edgewood Road, spoke in favor of the proposed PEG <br />channels, noted that Pacifica televises Council meetings and asked that TCI, <br />Inc. bring back Channels 32 and 54. <br />Rene White, 3981 Lonesome Pine Road, supported the proposed agreement and <br />agreed that PEG channels and public access are the vital components of <br />the agreement. <br />Council Members discussed the addition of the Public, Educational and <br />Government (PEG) access programming channel; gross revenues including <br />premium channels; escrow account for deposits of disputed payments; <br />Reg.
