Helen Graves, 371 Idyllwild Ct., Redwood City addressed the Council <br />concerning Item 2 of the Consent Calendar, the request for proposal for the <br />Cultural Resources Management of the Union Cemetery Historic site. Mrs. <br />Graves described the lack of a provision to provide funds to implement <br />recommendations as a serious deficiency in the RFP, and asked Council to <br />appoint a citizens committee to serve in an advisory capacity to the Park <br />and Recreation Commission to respond to inquiries regarding the cemetery. <br />Mayor La Berge advised that this matter would be referred to the Park and <br />Recreation Commission. <br />MEMO 12/10/90 <br />12W. W <br />15. PUBLIC HEARING - Density Bonus Ordinance (Item continued from October 15, <br />1990 and November 19, 1990) (203 -01). Affidavit of Publication is on file. <br />Report: Planning Commission, October 15, 1990 <br />Planning Director Patterson presented the staff report advising that state <br />law requires each city to provide a density bonus and at least one other <br />incentive to developers agreeing to construct a certain percentage of the <br />total units of a project for low and moderate income persons and families. <br />The proposed ordinance meets state guidelines including the required <br />condominium conversion provision. <br />In response to Council questions, City Attorney Schricker advised that those <br />people who convert apartments into condominiums are considered developers <br />under this law. <br />Councilman Murray_ advised that he did not favor a density bonus and that <br />zoning laws were more appropriate mechanisms, but the state requires cities <br />to enact these ordinances and the City must deal with it in a way that is <br />responsible. Councilman Murray stated that the City is entitled to more <br />latitude than the proposed ordinance provides, that G.C. Section 65915, the <br />general density bonus provision, has two alternative methods of providing <br />developer incentives for affordable housing; a density bonus, and a second <br />alternative that was included in the first draft but not the current one. <br />By rewriting state law, some provisions were omitted including this second <br />alternative. A convenient way to ensure referencing everything in a state <br />law is to reference the whole law itself. The law requires the City to enact <br />a method by which people can take advantage of the density bonus provision <br />that is in state law and cities can write in standards. <br />MINUTE BOOK NO. 50 Reg.
