<br /> 21) STORAGE. In the receipt, handling, care or custody of property of any kind shipped or otherwise delivered to the Fox Theatre, either prior
<br /> to, during or subsequent to the use of the Fox Theatre, by City, the Fox Theatre and its officers, agents and employees shall act solely for the
<br /> accommodation of City; and neither the Fox Theatre nor its officers, agents, or employees shall be liable for any loss, damage, or injury to such
<br /> property.
<br /> 22) OBSTRUCTIONS. No portions of the sidewalks, entries, passage vestibules, or way of access to public utilities of the premises shall be
<br /> obstructed, or caused to be obstructed, by City or caused or permitted to be used for any purpose other than ingress and egress to and from the
<br /> premises.
<br /> 23) MATERIALS. No flammable materials such as bunting, tissue paper, etc., will be permitted to be used for decorations; and all materials
<br /> used for decorative purposes must be treated with flame proofing and approved by the Fox Theatre. No smoke or steam machines may be used
<br /> inside the Fox Theatre.
<br /> 24) EXHIBIT ENTRANCE. All articles, exhibits, fixtures, materials, displays, etc., shall be brought into or out of the Fox Theatre only at
<br /> such entrances as may be designated by the Fox Theatre.
<br /> 25) CONTROL OF THE FOX THEATRE. The Premises, including keys thereto, shall be at all times under the control of GFV and other
<br /> authorized representatives of GFV shall have the right to enter the Premises at all times during the period covered by this Lease. The entrances
<br /> and exits of said Premises shall be locked and unlocked at such times as may be required for City's use of the Premises.
<br /> 26) NON-RESPONSIBILITY. GFV shall not be responsible for any damages or inability to provide the City with the use of the Premises
<br /> as agreed, if such inability is due to acts of God, fire, earthquake, strikes, labor disputes or other causes beyond the control of GFV. GFV
<br /> shall not be responsible for damages caused directly or indirectly by City's exhibitors, guests, attendees, invitees, or contractors. Neither shall
<br /> the Fox Theatre be responsible for property brought upon the premises by City, their exhibitors, guests, attendees, invitees, or contractors.
<br /> City shall, at his/her own expense, place any required and/or necessary security guards to assure the security of City's own property.
<br /> Notwithstanding the foregoing, GFV shall assure that doors to the Premises are secure and locked during non-use hours.
<br /> 27) OCCUPANCY DISRUPTION. In case the Premises or any part thereof shall be destroyed by acts of God, fire, earthquake or any other
<br /> cause, or if any casualty or unforeseen occurrence including but not limited to strikes, labor disputes, wars or acts of military authorities, shall
<br /> render the fulfillment of an Event difficult or impossible to perform, the Event shall be, at once, canceled and all sums paid to GFV shall be
<br /> immediately refunded to City. GFV shall not, in any case, be held liable or responsible to City for any damage caused by said cancellation, and
<br /> GFV shall be relieved from any further liability with respect to such Event by reason of this Lease, and no claims for compensation or damage
<br /> shall be made against GFV by City.
<br /> 28) RIGGING. Any changes to the certified rigging points in the Fox Theatre must be preapproved by GFV before City makes any
<br /> modifications or changes. If City requires modifications to Fox Theatre rigging points, it must utilize a licensed professional rigging company
<br /> approved by GFV, and assume all costs associated with changing or resetting the original rigging points.
<br /> 29) DISRUPTIVE PERSONS. GFV reserves the right to reject from the premises any person causing a disruption of any
<br /> Event or damage to the premises or a nuisance to other persons; and neither the Fox Theatre nor any of its officers, be liable to City for any
<br /> damages that may be sustained by City through the exercise by the Fox Theatre of such rights.
<br /> 30) SCHEDULING. Unless otherwise specified in writing, GFV shall be privileged to schedule other similar events before and after the date
<br /> of any reserved Event without notice to City.
<br /> 31) LOST ARTICLES. GFV or its representatives shall have the sole right to collect and have the custody of articles left in the building by
<br /> persons attending any event, performances, exhibition or entertainment given or held in the Premises, and the City or any person in City's
<br /> employ shall neither collect nor interfere with the collection or custody of such articles. GFV will provide reasonable notice to City with notice
<br /> and given two days to reclaim abandoned property.
<br /> 32) PERFORMER CONTRACT AND APPROVAL. City represents and warrants that City will have on the Event date contracts with any
<br /> performers who will be performing at such Event.
