7.A. - Page 3 <br /> • Stage 5 water shortage (greater than thirty percent reduction). <br /> The stages were designed to reduce the use of potable water by cutting discretionary <br /> uses first, and then by allocating water based on individual need, not historic use. <br /> Rather than relying on cutting water use by a percentage, the City has identified a <br /> number of actions that will achieve the desired water use reduction goals such as <br /> watering landscapes only two or three days per week, not filling swimming pools, and <br /> not flushing water mains. As water shortages increase, allocations will be set to meet <br /> the desired reduction goal. <br /> The WSCP has been updated to meet all current requirements as set forth by Governor <br /> Brown during the current drought and the regulations and statues as set forth by the <br /> State Water Resources Control Board and California Water Code. Further, California <br /> Water Code Section 375 et. seq. authorizes the City to adopt a Water Conservation <br /> Program (WCP) to impose additional regulations and restrictions on the delivery and <br /> consumption of water within the City's service area. Staff recommends, in addition to <br /> the WSCP, adoption of a WCP to prohibit nonessential water use and ensure <br /> compliance with the Governor's orders and State regulations. <br /> Ordinance No. 2062 is therefore proposed to be rescinded and will be replaced with a <br /> new resolution that is fully consistent with the Water Shortage Contingency Plan. A <br /> resolution (as opposed to a new ordinance) offers more flexibility to quickly adapt to <br /> changes in State requirements and will be brought to the Council for approval at the <br /> next scheduled City Council meeting. <br /> ALTERNATIVES <br /> The City Council may direct staff to further refine the Water Shortage Contingency Plan <br /> and return to Council at a later date. <br /> FISCAL IMPACT <br /> There is no direct fiscal impact related to rescinding this ordinance or for adopting the <br /> new Water Shortage Contingency Plan. However, in the event of a prolonged water <br /> shortage, conservation may result in reduced water sales and operating revenue <br /> potentially requiring water shortage related surcharges on water use. <br /> ENVIRONMENTAL REVIEW <br /> This Ordinance and Water Shortage Contingency Plan is categorically exempt from <br /> CEQA under CEQA Guidelines 15307 (Actions by Regulatory Agencies for Protection of <br /> Natural Resources). <br />
