11. The proposal and any contract entered into are subject to all applicable statutes,re,g 1.D. - Page 14 and orders of the federal, state, or District governments now in effect or which shah De in erect during the period of such contract. 12. The Contractor is required to comply with the California Penal Code Section 11077 (Department of Justice [DOJ] clearance of criminal history). In accordance with California Education Code Section 45125.1,the District is requiring that the Contractor provide DOJ information on all the Contractor's employees that will be working in the District before the start of the contract on July 1, 2016. 13. Bidders who do not wish to submit a bid are asked to return the Invitation for Bids indicating "no bid." 14. The District reserves the right to accept or reject any and all bids or any portion or combination thereof, or award on the basis of the total bid, and to waive any informalities and irregularities in this bid. The District reserves the right to award this bid by line item or in total whichever may be in the best interest of the District. 15. Bid must be submitted on the bid form provided by the District, and must include pages 5 & 6. All items on the form should be filled out. The completed form should be without interlineations, alterations or erasurers. 16. Bid must be in a sealed envelope that is clearly marked"GASOLINE& DIESEL FUEL BID - Bid No. 16-P-04-MOT" on the outside. The bid is to be mailed or delivered to Denise Buschke, Purchasing Supervisor, PALO ALTO UNIFIED SCHOOL DISTRICT, 25 Churchill Ave, Palo Alto, CA 94306,not later than Wednesday,April 25, 2016, at 3:00 p.m.. All bids will be opened at that time. Attendance not required. 17. Bids must be in complete compliance with specifications and will be subject to inspection, interpretation and approval by the District. Any deviations shall be indicated on the bid forms. 18. The bid should be verified before submission, as bids cannot be withdrawn after opening. No bid can be corrected or altered or signed after being opened. 19. Bids may be withdrawn before opening. 20. The Bid will be awarded to the lowest responsive and responsible bidder. 21. The Contractor shall be permitted to substitute securities for any monies withheld by the District to ensure performance under this contract, such substitution to be subject to the limitations and requirements of Public Contract Code Section 22300. 22. Any questions relative to the bid should be directed to the Purchasing Supervisor or designee at the address specified for receipt of bid proposals. 23. Any addenda or bulleting issued during the time of bidding shall form a part of the specifications issued to bidders for the preparation of their proposals and shall constitute a part of the contract documents. 11 OF 15 Bid No. 16-P-04-MOT
