11. The proposal and any contract entered into are subject to all applicable statutes,re,g 1.D. - Page 14 <br /> and orders of the federal, state, or District governments now in effect or which shah De in erect <br /> during the period of such contract. <br /> 12. The Contractor is required to comply with the California Penal Code Section 11077 <br /> (Department of Justice [DOJ] clearance of criminal history). In accordance with California <br /> Education Code Section 45125.1,the District is requiring that the Contractor provide DOJ <br /> information on all the Contractor's employees that will be working in the District before the <br /> start of the contract on July 1, 2016. <br /> 13. Bidders who do not wish to submit a bid are asked to return the Invitation for Bids indicating <br /> "no bid." <br /> 14. The District reserves the right to accept or reject any and all bids or any portion or combination <br /> thereof, or award on the basis of the total bid, and to waive any informalities and irregularities <br /> in this bid. The District reserves the right to award this bid by line item or in total whichever <br /> may be in the best interest of the District. <br /> 15. Bid must be submitted on the bid form provided by the District, and must include pages 5 & 6. <br /> All items on the form should be filled out. The completed form should be without <br /> interlineations, alterations or erasurers. <br /> 16. Bid must be in a sealed envelope that is clearly marked"GASOLINE& DIESEL FUEL BID - <br /> Bid No. 16-P-04-MOT" on the outside. The bid is to be mailed or delivered to Denise <br /> Buschke, Purchasing Supervisor, PALO ALTO UNIFIED SCHOOL DISTRICT, 25 Churchill <br /> Ave, Palo Alto, CA 94306,not later than Wednesday,April 25, 2016, at 3:00 p.m.. All bids <br /> will be opened at that time. Attendance not required. <br /> 17. Bids must be in complete compliance with specifications and will be subject to inspection, <br /> interpretation and approval by the District. Any deviations shall be indicated on the bid forms. <br /> 18. The bid should be verified before submission, as bids cannot be withdrawn after opening. No <br /> bid can be corrected or altered or signed after being opened. <br /> 19. Bids may be withdrawn before opening. <br /> 20. The Bid will be awarded to the lowest responsive and responsible bidder. <br /> 21. The Contractor shall be permitted to substitute securities for any monies withheld by the <br /> District to ensure performance under this contract, such substitution to be subject to the <br /> limitations and requirements of Public Contract Code Section 22300. <br /> 22. Any questions relative to the bid should be directed to the Purchasing Supervisor or designee at <br /> the address specified for receipt of bid proposals. <br /> 23.
