8.3.B. - Page 73 <br /> 9.8 Funeral Leave <br /> 9.8.1 In the event of a death in the immediate family of an employee of the City,that <br /> employee shall, upon request, be granted such time off with pay as is necessary <br /> to make arrangements for the funeral and attend same, not to exceed forty (40) <br /> regularly scheduled hours. This provision does not apply if the death occurs <br /> while the employee is on leave of absence, layoff or sick leave. <br /> 9.8.2 For the purpose of this provision, the immediate family shall be restricted to <br /> father, mother, brother, sister, spouse, domestic partner, child, half brother, <br /> half sister, step brother, step sister, mother-in-law, father-in-law, grandparent, <br /> grandchild, and stepfather, stepmother, stepchild in those cases where direct <br /> child rearing-parental relationship may be demonstrated to have existed. <br /> 9.8.3 In the event of the death of an active City employee, the City will excuse <br /> (without loss of pay) those employees who wish to attend the locally <br /> conducted funeral only to the extent it does not interfere with the operation of <br /> the City. <br /> 9.8.4 Funeral leave applies only in instances in which the employee attends the <br /> funeral, or is required to make funeral arrangements, but is not applicable for <br /> other purposes, such as settling the estate of the deceased. <br /> 9.9 Family and Medical Leave <br /> 9.9.1 In accordance with the California Family Rights Act of 1994, Government <br /> Code Sections 12940-12951, and the Family and Medical Leave Act of 1993, <br /> 29 U.S.C. Section 2601 et seq., regular part-time and full-time employees with <br /> one year or more of service are entitled to leave in accordance with City <br /> policy. <br /> 9.9.2 A male or female employee may be granted, at the Police Chief's discretion, a <br /> leave of absence without pay to fulfill parenting responsibilities for up to one <br /> (1) year following the child's birth or one (1) year following the filing of <br /> application for adoption and actual arrival of a child in the home (Parental <br /> Leave). The combination of pregnancy leave and parental leave shall not <br /> exceed one(1)year. <br /> 9.9.3 Family Medical Leave and California Family Rights Act Leave will run <br /> concurrently with Parental Leave as permitted by law. <br /> 9.10 Absence Notification <br /> Failure on the part of an employee to report for duty or notify the designated <br /> management official one-half(1/2) hour prior to the employee's scheduled starting time <br /> as to a reason why the employee cannot report may subject the employee to disciplinary <br /> action. <br /> 9.11 Personal Business Leave <br /> 27 <br />
