Code § 27383. <br /> IMPROVEMENT AGREEMENT <br /> 50, 80 and 88 Finger Avenue (The Grove) <br /> THIS IMPROVEMENT AGREEMENT ("Agreement") is made and entered into on <br /> thisDday of esfus& y� ; 20) ("Effective Date") by and between by and <br /> between Liberty H .TI Lane Partners, LP, a California limited partnership ("Developer"), <br /> and the CITY OF REDWOOD CITY, a charter city and California municipal corporation <br /> ("City") with reference to the following facts: <br /> RECITALS <br /> A. Developer is the current fee owner of that certain real property consisting <br /> of approximately 1 .7 acres located within the City of Redwood City, County of San <br /> Mateo , State of California , described in Exhibit A, attached hereto and incorporated <br /> herein by reference (the "Property"). <br /> B. On September 21 , 2015 , the City Council of the City of Redwood City <br /> adopted, among other approvals, Resolution No . 15445, approving the Vesting <br /> Tentative Map for the 50 , 80 and 88 Finger Avenue Project (The Grove) ("Project"), <br /> prepared by MacLeod and Associates and dated August 14, 2015 ("Tentative Map"), <br /> subject to certain conditions of approval ("Conditions"). <br /> C. The Conditions require either ( 1 ) that certain public improvements for the <br /> Project be constructed prior to approval of the Final map ("Final Map"), or (2 ) that <br /> Developer enter into an agreement with City providing for the future construction of such <br /> public improvements. <br /> D. Developer has submitted the Final Map and applied to City for Final Map <br /> approval without having completed the required public improvements and , therefore, will <br /> enter into an agreement with City providing for the future construction and installation of <br /> such public improvements, as required by Government Code section 66462(a)( 1 ). <br /> E.
