damage which may arise from County's operations under this Contract, whether <br /> such operations be by County or by any sub-contractor or by anyone directly or <br /> indirectly employed by either of them. The mount of such insurance shall be five <br /> hundred thousand dollars ($500,000) combined single limit bodily injury and <br /> property damage for each occurrence. After three (3) weeks from the date this <br /> Contract is first executed, the City may, at its sole discretion, require an increase in <br /> the amount of liability insurance to the level then customary in similar City <br /> Contracts by giving sixty (60) days notice to County. The City and its officers, <br /> agents, employees and servants shall be named as additional insured on any such <br /> policies of insurance, which shall also contain a provision that the insurance <br /> afforded thereby to the City, its officers, agents, employees and servants shall be <br /> primary insurance to the full limits of liability of the policy, and that if the City, or <br /> its officers and ~mployees have other insurance against a loss covered by such a <br /> policy, such other insurance shall be excess insurance only. <br /> 2). In the event of the breach of any provision of this section, or in the event any notice is <br /> received which indicates any required insurance coverage will be diminished or canceled, <br /> the City's Housing Coordinator, at his or her option, may, notwithstanding any other <br /> provision of this Contract to the contrary, immediately declare a material breach of this <br /> Contract and suspend all further work pursuant to this Contract. <br /> 3) County is a legally self-insured public entity, and may alternately provide the levels of <br /> liability, workers compensation, vehicle liability and professional coverage through its <br /> self-insurance program to and including any excess insurance coverage supplementing <br /> the County's self-insurance program. <br /> <br />J. Changes to Work SO0p~ <br /> No changes in the scope of work as described in this Contract shall be made without written <br /> approval of the City. <br /> <br />K. AssignabiliW <br /> The County shall not assign in this Contract, and shall not transfer any interest in the same <br /> (whether by assignment or novation), without the prior written consent of the City thereto, <br /> provided, however, that claims for money due or to become due to the County from the City <br /> under this Contract may be assigned to a bank, trust company, or other financial institution <br /> without such approval. Notice of such assignment or transfer shall be furnished promptly to <br /> the City. Any transfer or assignment of the interest in the partnership shall require the prior, <br /> written consent of the City. <br /> <br /> L. Inspection of Work <br /> It is understood that periodic review of the County's work may be necessary and the right to <br /> so review is reserved by the City. <br /> <br /> <br />
