Except as specifically amended <br />by this document, all other terms and conditions of the Existing Agreement will remain In full force and effect, without modification. <br />Now, therefore, in consideration of the above facts and of the covenants and agreement contained herein, the parties hereto agree <br />that: <br />Out -of -Scope Work ($39,245) <br />PlaceWorks has conducted more work than anticipated in the initiation of the project, including the following: <br />■ More than one round of review and revision of the Project Description (four rounds as of lune 2018). <br />■ Review of more than one submittal of the construction details spreadsheet (five versions as of June 2018). <br />■ Project management averages due to schedule delays. This contract modification includes an allowance to cover this additional <br />work to date as well as project management for the remainder of the project. <br />In addition, the original (2015) site plan, upon which the existing agreement is based, included within the site plan the block to the <br />west of Woodside Road that is bounded by Broadway, Woodside Road, Bay Road, and Chestnut Street. Revised site plans for the <br />proposed project include an additional site (referred to herein as the "Say Block") on the east side of Woodside Road that is bounded <br />by Woodside Road, Bay Road, Broadway, and Charter Street. This contract modification account for the addition of the Bay Block in <br />the project description, construction data, environmental setting, and impact analysis of Environmental Impact Report (EIR). <br />Billing Rate Increase ($8,885) <br />The billing rates for PlaceWorks staff have increased since the project began.
