The recitals set forth above are true and correct, and are hereby <br />incorporated herein by this reference as if fully set forth in their entirety. <br /> <br />2. The City Council declares its intention to vacate the public right-of-way <br />being a portion of Hancock Street, Spruce Street, and Buckeye Street as shown on the <br />Record of Survey Map No. 2383 in Volume 38, on the basis that it is unnecessary for <br />present or prospective public purposes. <br /> <br />3. The City declares that, the vacation will be conditioned upon the reservation <br />of a Public Utility Easement (PUE), Access Easement, and Stormwater Easement over <br />the formerly public right of way. <br /> <br />4. A noticed public hearing on the question of vacating the public right-of-way <br />being a portion of Hancock Street, Spruce Street, and Buckeye Street, shall be held and <br />evidence thereon received by the City Council on December 12, 2016. <br /> <br />5. The public right-of-way being a portion of Hancock Street, Spruce Street, <br />and Buckeye Street to be vacated is more fully described in Exhibit 1 and Exhibit 2 <br />attached hereto and by this reference incorporated herein. <br /> <br />6. The City Clerk is hereby authorized and directed to publish and post notices <br />of the public hearing on the public utility easement vacation in accordance with Streets <br />and Highways Code Sections 8322 and 8323. <br /> <br />* * * <br />6.3.C. - Page 4
