<br /> - <br /> DUPLICATE ORICIIIAI. <br /> SOUTH BA YSIDE SYSTEM AUTHORITY <br /> Redwood City, California <br /> LEASE AGREEMENT <br />RECYCLED WATER TREATMENT/STORAGE/PUMPING FACILITY SITE <br />THIS LEASE AGREEMENT ("Lease"), dated for convenience as of <br />August 1, 2004, is made and entered into by and between the SOUTH BA YSIDE <br />SYSTEM AUTHORITY, a public agency of the State of Califomia, ("Lessor"), <br />and the City of Redwood City, a municipal corporation in the State of Califomia, <br />("Lessee" ); <br /> WIT N E SSE T H: <br />Lessor and Lessee are concurrently parties to the Agreement for <br />Production and Delivery of Recycled Water, dated as of August 1, 2004, and <br />incorporated herein by reference ("Agreement"). <br />Lessor, for and in consideration of the rental payments provided for herein <br />and of the mutual agreements, terms, covenants, and conditions herein <br />contained, does hereby lease, let, and demise to Lessee, and Lessee does <br />hereby lease, hire, and take from Lessor, the real property more particularly <br /> - <br />described on Exhibit "A" and depicted on Exhibit "B" hereof, attached hereto and <br />by this reference incorporated herein. Lessor further grants Lessee for the term <br />of the Lease Agreement non-exclusive easements for ingress, egress and <br />utilities in and over the areas described and depicted on Exhibits "C-1, C-2, C-3 <br />and C-4", attached hereto and incorporated by this reference. <br />1. TERM. This Lease shall commence on January 1, 2006, and shall <br />end on December 31, 2056 (the "Term"), unless earlier terminated.
