<br />have the opportunity at all times during the term hereof to utilize to the maximum <br />extent reasonably practicable the Leased Premises for the use described herein. <br />4. ABATEMENT. If, at any time during the term hereof, the Leased <br />Premises are damaged by fire, flood, earthquake, explosion, land subsidence, <br />the public enemy or acts of God, or the provision thereof ceased, or the operation <br />thereof abated, by lawfully constituted govemment authority (other than Lessor) <br />so as to render said Leased Premises or facilities partially untenantable or unfit <br />for use, then there shall be a proportionate reduction of obligations of Lessee to <br />pay rent hereunder according to the nature and extent of the damage sustained. <br />If, because of any of said causes, the Leased Premises or facilities shall be <br />rendered wholly or substantially untenantable or unfit for use so as to make it <br />unreasonable for Lessee to use said Leased Premises, then Lessee shall have <br />the right to terminate this Lease by giving not less than thirty (30) days prior <br />written notice thereof to Lessor. <br />5. UTILITIES. Lessee shall pay for all water, gas, heat, electricity, fuel, <br />power, telephone service, and other utilities which may be advanced to or used <br />in or about the Leased Premises during the Term of this Lease. All utilities - <br />provided by Lessor to Lessee shall be charged to Lessee at Lessor's cost and <br />Lessee shall pay all utility invoices upon demand but not more frequently that <br />once a month. <br />Lessee shall bear the cost and expense of relocating any of Lessor's utility <br />facilities, whether within or outside of the Leased Premises, necessitated by <br />Lessee's operations under this Lease. Such relocation shall be subject to <br />Lessor's prior approval and in accordance with such reasonable terms and <br />conditions as Lessor shall establish. <br />4 1108669.4 <br />
