yard of the homes, which is not legally permitted by the Zoning Ordinance. <br /> <br /> Council may opt to leave the street unimproved until a broader strategy dealing with <br /> unimproved streets is developed. However, if the decision is made to improve the street <br /> to current City standards, two possibilities exist. The City might install rolled curbs e.g. <br /> along Canyon Road; or conventional curb and gutter might be used. If the improvements <br /> are to be made by the developer or the City, staff recommends conventional curb and <br /> gutter. The rolled curb will not preserve much additional on-street parking over the <br /> conventional approach. In addition, the area has a relatively urban feel and the adjacent <br /> streets all have conventional curb and gutter. A "modified" City standard with rolled curbs <br /> for the street (as discussed at the Council meeting) would cost nearly as much as the <br /> standard street due to minimum paving requirements, curbs, gutters, and storm drainage. <br /> <br /> The quid pro quo for a developer obtaining certain rights that go with a Development <br /> Agreement usually requires offsite improvements over and above those required by <br /> Ordinance. To grant a Development Agreement and not require some additional offsite <br /> improvements could set a precedent. <br /> <br /> Conclusion <br /> Staff believes the $124,931 is a reasonable estimate of the cost to improve the balance <br /> of Willow Street. The documents presented to you for the meeting allow the developer to <br /> make the improvements or pay the fee at their option.
