Development Agreement Terms (DA) <br />The attached draft DA reflects the results of these negotiations. Following are the major <br />issues raised by the DA. <br /> <br />Term <br />The DA has a total 5-year term, with the reauirement that construction must be <br />'substantially commenced' by the second annivers~' date; and that construction must be <br />'substantially completed' by the third anniversary. The owners indicated agreement with <br />this term when the issue came before the Planning Commission. <br /> <br />Fees and Exactions <br />On page xx you will find sections entitled 'Standard Improvements' and 'Additional <br />Improvements'. These have been the subject of most discussion during the negotiation <br />and are covered in more length following. <br /> <br />Standard Improvements <br />There are a variety of improvements that Redwood City requires of every developer, with · <br />or without a DA. These are described more precisely in Exhibit C but in summary form <br />they include: <br /> <br />· Developers are required to make offsite improvements adjacent to the project. The <br /> owner must make improvements to the half of Willow Street adjacent to the property, <br /> including new curb, gutter and sidewalk, storm drains and street trees. <br /> <br />· The City's standard requirement is that developers must underground utility lines <br /> adjacent to the property. The subject parcel has overhead lines on both the Middlefield <br /> and Willow faces of the property. Given the small size of the project, and the fact that <br /> there are no other projects that would underground any other lines in the vicinity of this <br /> site, staff agreed to a fee of $58,134 in lieu of undergmunding power lines adjacent to <br /> the Middlefleld road side of the properbj=. The owners have agreed to underground the <br /> lines on the Willow Street side. <br /> <br />Additional Improvements <br />This section describes the consideration the City will receive for entering into the DA. As <br />already noted, the owner is required to make improvements to the centerline of Willow as <br />part of their standard improvements. When we began negotiations over the DA, staff's <br />original notion was for the owner to make the improvements to the remainder of the <br />roadway when they did the other work on Willow Street. The owner resisted this idea and <br />instead proposed an in-lieu fee. Staff agreed to the in-lieu fee for two reasons: <br /> <br /> 1. There are no curbs, gutters or sidewalks on the street. There would need to be <br /> some significant grade changes to ensure that installation of new sidewalk did <br /> not create drainage difficulties with the other properties on the street. This <br /> owner would have to get agreements from adjacent owners to accomplish the <br /> <br />2 This fee is derived from the frontage dimension on Middlefield Road multiplied by an estimated cost of <br /> <br />$600 per linear foot of undergrounding (96.89 x $600). The cost of $600 per linear foot is based on <br />Engineering's recent experience with undergrounding projects. <br /> <br /> <br />
