REPORT <br /> To the Honorable Mayor and City Council <br /> From the City Manager <br /> <br />May 6,2002 <br /> <br />Subject <br />Establishment of Rules and Regulations for Administration and Regulations of Waterways of the City <br />of Redwood City. <br /> <br />Recommendation <br />Adopt an ordinance of the City of Redwood City to establish rules and regulations for administration <br />of waterway rules and regulations. <br /> <br />Background <br />On June 25, 2001, the City Council was presented with recommendations from the police <br />department concerning the enforcement of local laws in Redwood City waterways. The existing <br />Tariff 7 Rules and Regulations, that was adopted in 1998 by the Port of Redwood City, does not <br />have enforcement provisions with penalties as required by State law. Therefore, the Tariff is <br />unenforceable by the police department. The City Council agreed to have the City's Attorney's <br />Office revise the current ordinance regarding rules and regulations within the waterways of Redwood <br />City, which would allow enforcement by the police department. <br /> <br />On November 26, 2001, Council was presented with the proposed ordinance. At that time, Council <br />introduced an ordinance adding Chapter 44 to the Redwood City Code regarding the establishment <br />of rules and regulations for the administration of the harbor. <br /> <br />On November 28, 2001, the proposed ordinance was introduced to the Board of Port <br />Commissioners. <br /> <br />The proposed ordinance was then submitted to the California Department of Boating and <br />Waterways on December 12, 2001 for review. Upon review by Cai Boating, the ordinance was <br />revised in two areas. In Section 44.8, the reference to gray water and bilge water was removed. In <br />addition, Sections 44.24 to 44.27 were also removed, as the Harbor & Navigations Code preempts <br />these sections. <br /> <br />The attached document is the final revision of the ordinance. <br /> <br />Alternative <br />Continue to use Tariff 7 and the Harbor & Navigations Code rules and regulations on the waterways <br />of Redwood City. Since there are loopholes in the enforcement of these regulations, this would not <br />accomplish our goal of keeping the waterways free of derelict vessels. <br /> <br />Fiscal Impact <br />None. <br /> <br /> <br />
