channel facilities consistent with federal law. Currently, federal law only allows for <br />purchases associated with capital expenditures for PEG facilities or operational <br />equipment. The use of PEG fees for the proposed AV system is appropriate and <br />complies with federal law. <br /> <br />ANALYSIS <br />The current balance of available, unrecognized PEG revenue is $524,063 from the <br />following: <br />· AT&T: $48,585 <br />· Comcast: $368,869 <br />· Wave (a.k.a. Astound, RCN): $106,609 <br /> <br />The City will be able to implement a modern, stable, supportable, feature-rich broadcast <br />system by adopting a resolution recognizing $350,000 of PEG fees as revenue, and <br />appropriating the additional revenue for the Chamber AV system replacement. <br /> <br />ALTERNATIVES <br />Council could direct staff to not replace the aging system and attempt to fix any failed <br />components and functions as they occur, although some components can no longer be <br />acquired and stability has been an ongoing issue. <br /> <br />Council could direct staff to find replacements for components of the AV system which <br />are most visible and problematic, such as voting, displays, hearing assisted loops, and <br />operational panels. <br /> <br />FISCAL IMPACT <br />Sufficient PEG funds are available as unbudgeted and unappropriated revenue. <br /> <br />ENVIRONMENTAL REVIEW <br />This activity is not a project under CEQA as defined in CEQA Guidelines, section <br />15378, because it has no potential for resulting in either a direct or reasonably <br />foreseeable indirect physical change in the environment. <br /> <br /> <br />TONY GELPHMAN <br />STAFF ORIGINATOR <br /> <br /> <br />6.3.A. - Page 2
