Mr. and Mrs. Thompson, owners of Carl's Jr., 1001 Veterans Blvd., described their fast food business as the only one in Redwood City without a drive-through service, and asked the Council for fairness. In response to Council questions Planning Director Patterson described the prohibition against drive-through services in CP (Commercial Park) Districts where Carl's Jr. is located, and the approval of same in CG (General Commercial) and IR (Industrial Restricted) Districts where others are located; and, advised rezoning hearings are scheduled that will address this issue. Council Members discussed bases for appeal, traffic impacts, fairness, rezoning, variances and timeliness. Mayor La Berge asked if anyone else wished to speak. speak. Speaking to the question and in answer to Council questions, City Attorney Schricker advised there was no ambiguity in the Zoning Ordinance; however, the Council could retain jurisdiction and remand this issue to the Zoning Administrator and suggest that applicants apply for a variance, which addresses unique circumstances of a particular parcel of property which are not inconsistent with the general requirements of the Zoning Ordinance. Planning Director Patterson advised amending the Zoning Ordinance would be more appropriate than granting a variance.
