ORIGINAL <br />AMENDMENT NO. Z TO EXTEND AND AMEND AGREEMENT FOR <br />Public information and Outreach Services <br />Redwood City Recycled Water Project <br />(Data Instincts) <br />This Amendment No. 2 is entered into and effective as of the .~~ day of <br />~ ,.,(o,~, 2007, extending and amending the agreement dated <br />August 26, 2004 (the "Agreement") by and between the City of Redwood City, a charter <br />city and municipal corporation of the State of California ("City"), and Data Instincts, <br />("Consultant") (collectively, the "Parties") for the Recycled Water Project -Public <br />Information and Outreach Services. <br />RECITALS <br />A. The Pa~~ties desire to continue Agreement's scope of work and services for at <br />least 18 additional months. <br />B. The Parties have negotiated and agreed to a supplemental scope of work <br />and fee schedule, which is attached to and incorporated by this reference as Exhibit <br />"A", -Scope of Services and Exhibit "B" -Schedule of Fees. <br />NOW, THEREFORE, in consideration of these recitals and the mutual covenants <br />contained herein, the Parties agree as follows: <br />1. In addition to those services contained in the Agreement, as may have <br />been amended from time to time, Consultant will provide those services described in <br />Exhibit "A." <br />2. That the Agreement, as may have been acme nded from tiiiie to time, iS <br />hereby extended and shall expire upon completion of work, and Consultant will be paid <br />on an hourly basis up to the amount of Two Hundred Eighteen Thousand Twenty Five <br />dollars ($218,025.00). The amended not-to-exceed authorization for the Agreement will <br />increase by Two Hundred Eighteen Thousand Twenty Five dollars ($218,025.00) from <br />Three Hundred Sixty Nine Tho! sand, Five Hundred Fifty dollars ($3E9,550.00) to Five <br />Hundred Eighty Seven Thousand Five Hundred Seventy Five dollars ($587,575.00}. <br />3. Consultant will complete all work described in Exhibit "A". <br />4. All other provisions of the Agreement, as may have been amended from <br />time to time, will remain in full force and effect. <br />5. All requisite insurance policies to be maintained by Consultant pursuant <br />to the Agreement, as may have been amended from time to time, will include coverage <br />for this Amendment. <br />6.
