Section 2. 03. Waivers of Development Standards. <br /> In accordance with Section 65915(e) , OWNER has proposed the waiver of, and <br /> the City has agreed to waive, the following development standards that would otherwise <br /> apply to the Project under City land use and zoning regulations. OWNER hereby <br /> acknowledges and agrees that the City's waiver of the following development standards <br /> fully satisfies the City's obligations to waive development standards under the Density <br /> Bonus Law. <br /> (a) Building Height More than 4 Stories and 50' : OWNER has <br /> requested a waiver of, and City has agreed to waive, the applicable height restriction to <br /> allow an increased building height from 4 stories and 50 ft. to 6 stories and 74 ft. <br /> (b) Building Length More than 200': OWNER has requested a waiver <br /> of, and City has agreed to waive, the applicable building length restriction to allow for an <br /> increased building length from 200 ft. to 330 ft. <br /> Section 2.04. Application of Statutory Parking Standards. <br /> OWNER has requested, and the CITY has agreed, that the parking standards set <br /> forth in Government Code Section 65915(p) shall be applied to the Project. <br /> Article Ill <br /> Number and Location of Affordable Units <br /> Section 3.01 . Number of Affordable Units and Bedrooms. <br /> OWNER, as a condition to the satisfaction of OWNER's affordable housing <br /> obligations as set forth in the Project Approvals and Density Bonus Law, and in <br /> accordance with the AHP, OWNER shall construct, or cause to be constructed, seven (7) <br /> Affordable Units, comprised of one (1 ) junior one-bedroom unit, two (2) one-bedroom <br /> units, three (3) two-bedroom units, and one ( 1 ) three-bedroom unit, and totaling twelve <br /> ( 12) bedrooms, in the unit mix more particularly set forth on the attached Exhibit "C. " <br /> Section 3.02. Location of Affordable Units. <br /> The Affordable Units shall be the type of units as shown on the attached Exhibit <br /> "C" and shall be constructed on the Property in the locations(s) shown or described in the <br /> attached Exhibit "C, " and the types of units and their respective locations shall not be <br /> changed without the approval of the City, which shall not be unreasonably withheld. <br /> Section 3. 03. Quality, Size and Amenities of Affordable Units. <br /> The Affordable Units shall be comparable in quality, size and amenities (at the <br /> same cost as otherwise available for other tenants) to those units which will be available <br /> to tenants of the units not designated as Affordable Units ("Market Rate Units"), subject to <br /> variations in interior finishes which shall be reviewed and approved by the City prior to the <br /> issuance of any Certificates of Occupancy.
