Code § 27383. <br />F"ROVEMENT AGREEMENT <br />24H0UR FITNESS,1050BROADW AY STREET <br />THIS IMPROVEMENT AGREEMENT ("Agreement") is made and entered into on this tay of <br />Alvvl�_'� H , 2Dt ''("Effective Date") by and between by and between SunCap Redwood, LLC, a <br />North Carolina limited liability company ("Developer"), and the CITY OF REDWOOD CITY, a charter <br />city and California municipal corporation ("City") with reference to the following facts: <br />RECITALS <br />A . Developer is the current fee owner of that certain real property consisting of <br />approximately 2.93 acres located within the City of Redwood City, County of San Mateo, State of <br />California, described in Exhibit A. attached hereto and incorporated herein by reference (the "Property"). <br />B . On May 7, 2013, the Planning Commission of the City of Redwood City adopted, <br />among other approvals, Resolution No. 13-08, approving the Vesting Tentative Map for the construction <br />of a two story health club with onsite surface parking and associated site improvements (the "Project"), <br />prepared by BKF Engineers and dated March 3, 2013 ("Tentative Map"), subject to certain conditions of <br />approval ("Conditions"). <br />C . The Conditions require either (1) that certain public improvements for the Project be <br />constructed prior to approval of the final map ("Final Map"), or (2) that Developer enter into an <br />agreement with City providing for the future construction of such public improvements. <br />D . Developer has submitted the Final Map and applied to City for Final Map approval <br />without having completed the required public improvements and, therefore, will enter into an agreement <br />with City providing for the future construction and installation of such public improvements, as required <br />by Government Code section 66462(a)(1). <br />E . Developer has submitted to City plans, specifications and drawings entitled <br />"Improvement Plans 24 Hour Fitness, 1050 Broadway Street", prepared by BKF Engineers and dated <br />November 11, 2013 (the "Improvement Plans'), which, in addition to other improvements, provide for <br />certain on-site public improvements consisting of street and street light improvements, storm drain <br />systems, domestic water systems and sanitary sewer systems for the Project (collectively, <br />"Improvements"). <br />F.
