RESOLUTION NO. <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD <br />CITY VACATING A PORTION OF THE HANCOCK STREET, SPRUCE <br />STREET, AND BUCKEYE STREET PUBLIC RIGHT OF WAY IN THE <br />CITY OF REDWOOD CITY PURSUANT TO PART 3 OF DIVISION 9, <br />CALIFORNIA STREETS AND HIGHWAYS CODE OF THE STATE OF <br />CALIFORNIA <br />WHEREAS, pursuant to the provisions of Part 3 (commencing at Section 8300) of <br />Division 9 of the California Streets and Highways Code, the City Council of the City of <br />Redwood City ("City Council"), hereby vacates the public right-of-way being a portion of <br />Hancock Street, Spruce Street, and Buckeye Street as shown on the Record of Survey <br />Map No. 2383 in Volume 38 of LLS Maps, at Page 11, in the office of the Recorder for <br />the County of San Mateo; is attached hereto as Exhibit 1; and <br />WHEREAS, because there are in-place utilities that are in use, vacation of the <br />public right-of-way is subject to a reservation of a public service easement and right to <br />construct, maintain, operate, replace, remove, or renew public service facilities, attached <br />hereto as Exhibit 2, unless the City Council determines the public convenience and <br />necessity require otherwise; and <br />WHEREAS, because there is a need to provide continued access to the State of <br />California right-of-way, vacation of the public right-of-way is subject to a reservation of a <br />an maintenance access easement to provide for maintenance access, attached hereto <br />as Exhibit 3, unless the City Council determines the public convenience and necessity <br />require otherwise; and <br />WHEREAS, because there is a need to provide for the collection and transmission <br />of stormwater, vacation of the public right-of-way is subject to a reservation of a <br />stormwater easement to provide for collection and transmission of stormwater, attached <br />hereto as Exhibit 4, unless the City Council determines the public convenience and <br />necessity require otherwise; and <br />WHEREAS, pursuant to said provisions of the California Streets and Highways <br />Code, notice of intention to vacate the herein described portion of Hancock Street, Spruce <br />Street, and Buckeye Street as shown on the Record of Survey Map No. 2383 in Volume <br />38 of LLS Maps, at Page 11, was published and posted in substantially the form attached <br />hereto as Exhibit 5 (public hearing notice), as well as noticed to property owners within <br />300 feet; and <br />WHEREAS, the City also sent utilities notice of its intention to vacate in <br />substantially the form attached hereto as Exhibit 6 (Notice to Utilities); and <br />Page 1 of 28 <br />ATTY/RESO.0122/CC RESO HANCOCK STREET, SPRUCE STREET, AND BUCKEYE STREET PUBLIC RIGHT OF WAY <br />REV: 12-06-16 RL <br />
