Upon receipt of Eligibility Documents within the requisite 30 day <br />period, OPC will review the Household's eligibility. All documents retained by OPC will <br />remain confidential unless disclosure is required by law. <br />All Households having met the eligibility requirements will be issued a Notice of Eligibility <br />(“NOE”) detailing the level of assistance they will receive. Any Household that has been <br />determined not to be eligible to receive assistance under the Relocation Assistance <br />Program, that fail to return any requested Eligibility Documents to OPC within 30 days, or <br />person(s) that do not meet the definition of Household will be issued a Notice of <br />Ineligibility. <br />Any Household that is in disagreement with a Notice of Eligibility or a Notice of Ineligibility <br />may appeal such determination to the City Manager by filing a Notice of Appeal within 15 <br />days of the date the Notice of Eligibility or Ineligibility is issued. Upon receipt of a timely <br />filed Appeal, the City Manager or his/her designee shall fix a time and place for hearing <br />the appeal. The appeal shall be heard by an independent Hearing Officer designated by <br />the City Manager. The decision by the Hearing Officer shall be deemed final. A written <br />notice of the decision on the appeal shall be sent by regular mail. The notice shall advise <br />that any action challenging the decision of the Hearing Officer must be filed with the <br />Superior Court of the County of San Mateo pursuant to Code of Civil Procedure Section <br />1094.5 and that judicial review must be sought within 90 days following the date of the <br />written notice. <br />In order to become and remain eligible for relocation assistance, any Tenant or Sub- <br />tenant must execute an Agreement to Relocate with the City and any Tenant must also <br />be deemed in Good Standing with the City. <br />Classifications of Persons Eligible for Relocation Assistance: The Relocation <br />Assistance Program contemplates three classifications of persons who may be eligible to <br />receive assistance. Specific types of assistance are described for each classification later <br />in this Section of the Docktown Plan. Table 6 at the end of this Section provides a matrix <br />of the types of assistance available to each classification.
