S 0 7 <br />Councilman Bury moved to approve Minutes of September 26, 1966. Councilman Hender- <br />son stated in the 6th paragraph, page 1, sentence should have read "Councilman Peter- <br />sen reminded Council and Staff of his suggestion concerning damming the creek to <br />create a pond" instead of "damming the creek to create a swimming pool". Councilman <br />Petersen concurred with this statement. Also on page 7 regarding Report of College <br />Site Committee, it was requested that sentence be added: "Councilmen Keckley and <br />Petersen expressed concern regarding the funds." Also, in regard to amendment of <br />Section 801, Ordinance 1128, Councilman Henderson requested that her statement <br />expressing concern over the possibility of losing the Tax Exempt status of municipal <br />bonds, be included. <br />Mothod of making additions and corrections of the minutes was discussed at some <br />length. Councilman Bury moved to approve minutes as corrected, seconded by Council- <br />man Keckley, and carried. <br />PUBLIC HEARING, Assessments and assessment Diagram, Alley Improvement District, 1966, <br />declared open and affidavits of publication and posting ordered filed. <br />Following written protests were read in full: <br />William J. Graham, Attorney for Mr. Mike Determan, Assessment <br />5-13, $660.17 protesting amount of assessment and need for any <br />improvements. <br />Mr. & Mrs. Luigi Ferrari, Assessment 7-9, $1,094.30, complaint <br />concerning drainage problem alleged to be increased by improve- <br />ment of alley. <br />Mr. & Mrs. E. Watts, Assessment 5-22, $880.25 protest cost of <br />work and questioned need for improvements. <br />The following appeared: <br />Mr. Frank Olivera, 220 Madison, to protest the high cost of the <br />improvements, compared to the cost in 1950. <br />Bud Grace, 1353 Jefferson, appeared to state that his fence had <br />been pulled down without his having been notified that this <br />would be done, and questioned responsibility for replacement. <br />It was decided that Mr. Grace should contact Public Works Director for this matter <br />to be looked into. <br />In response to questions from the Council, Mr. C. W. Lebsack, Attorney for the <br />District appeared to state that the purpose of the public hearing was to find out if <br />there were any problems, because this public hearing would complete the assessment <br />procedures. Specifically, the questions to be decided by Council are (1) was the <br />work done in accordance with the plans and specifications; (2) were the costs rea- <br />sonable and equitably spread. <br />Councilman.'Petersen questioned if the Determan property assessment is in line with <br />the rest of assessments. Director of Public Works stated it is in accordance with <br />assessments for balance of props^ty. He stated he was prepared to go into complete <br />detail with Council on assessments if required to do so. Councilman Petersen asked <br />if anyone has been in correspondence with Mr. Determan about these assessments, since <br />he does live out of state. <br />Director of Public Works answered that after searching through files, did not find <br />copy of letter to Mr. Determan, and questioned necessity of a reply. <br />
