<br /> 1 <br /> insurance to the full limits of the liability of the policy, and that if City, <br /> its, Council, officers, boards, commissions, agents and employees <br /> have other insurance against a loss covered by such a policy, such <br /> other insurance shall be excess insurance only. <br /> 7. Abandonment. In the event that Permittee abandons or fails to use the <br /> City Right-of-Way, or shall fail, neglect, or refuse to maintain the private building and <br /> the entire encroachment area in a clean and good working condition, or to comply with <br /> any of the conditions herein contained, or in the event that this permission shall be <br /> revoked, then all rights of Permittee hereunder shall forthwith cease and terminate. <br /> Permittee agrees to be solely responsible for all the costs associated with the safe <br /> abandonment of the building and other structures to the satisfaction of the City. <br /> 8. At the request of the City, Permittee shall realign or relocate the private <br /> building/structure at Permittee's expense, if these structures interfere with any City <br /> facilities the City may install in the future. Permittee shall relocate the private <br /> building/structure within sixty (60) days of a notice from the City to Permittee, and <br /> delivered to the address above. <br /> 9. Assiqnments. The permit and the privileges granted to Permittee <br /> hereunder shall not be assigned by Permittee without the prior permission of City. <br /> Evidenced by motion of City's City Council, duly made and carried; provided, that no <br /> such assignment shall be made which would allow or permit a use of the City Right-of- <br /> Way different than Permittee's use thereof or for a private for-profit use. <br /> 'I <br /> Atty/Permits/Permit.010 4 <br /> 040604 <br /> .- "T ....... . 1 . .- <br />
