<br />GENERAL RELEASE
<br />For and in consideration of Fifteen Thousand One Hundred Ninety and 00/100 dollars ($15,190.00)
<br />paid to the undersigned City of Redwood City by PACIFIC GAS AND ELECTRIC COMPANY (hereafter
<br />called PG&E), receipt whereof is hereby acknowledged, the undersigned do (does) hereby acknowledge full
<br />payment, satisfaction and discharge, in compromise of all loss, expense, injuries to person, loss of services,
<br />damage to property, liability, claims, demands and causes of action of whatsoever kind or nature, now known
<br />or hereafter discovered resulting from, or in any manner arising out of, or in anyway directly or indirectly
<br />connected with that accident, casualty or event which occurred on or about the 5th day of May, 2003, at or
<br />near 801 Woodside Road, Redwood City State of California ("the incident").
<br />In consideration of the payment of $15,190 the undersigned as it relates to its person(s) or property,
<br />do (does) hereby release and forever discharge PG&E and its officers, employees and agents from any an
<br />all loss, expense, injuries to persons, loss of services, damage to property, liability, claims, demands and
<br />causes of action arising from the incident.
<br />The undersigned expressly understand and agree that the payment by PG&E is by way of
<br />compromise only, and that PG&E does not admit, and shall not be deemed to have admitted, any fact or
<br />facts of any liability whatsoever with respect to the incident; and in the execution hereof the undersigned
<br />have (has) acted solely upon his own information and not upon any statement of fact made by PG&E, or by
<br />any person acting for or on PG&E'S behalf.
<br />The undersigned further represent(s) that he would have entered into this agreement regardless of
<br />whether PG&E did or did not admit that it was responsible for the injuries to person and/or damage to
<br />property sustained by him.
<br />The undersigned expressly waive(s) all rights under Section 1542 of the Civil Code of the State of
<br />California, which reads as follows: "A general release does not extend to claims which the creditor does not
<br />know or suspect to exist in his favor at the time of executing the release, which if known by him must have
<br />materially affected his settlement with the debtor."
<br />The undersigned represent(s) that he would have made and signed this release if the nature and
<br />extent of the injuries to person and/or damage to property were different or greater than now appear, and
<br />intend(s) this General Release to extend to all loss, expense, injuries to its person, loss of services, damage
<br />to property, liability, claims, demands, and causes of action, resulting from the incident, whether known or
<br />unknown, suspected or unsuspected to unknown and unanticipated consequences resulting from either
<br />known or unknown injuries to person and/or damage to property, and to all injuries to the person of the
<br />undersigned even though the injuries may be permanent and progressive and that recovery therefrom is
<br />uncertain and indefinite; the intention hereof being to release completely, absolutely, and finally PG&E, its
<br />officers, employees and agents, from all liability to the person of the undersigned or its property of
<br />whatsoever kind or nature, past, present and future, arising or resulting wholly or partially from the incident
<br />without regard to the nature and/or extent of such injuries to the person of the undersigned and/or damage to
<br />its property.
<br />The undersigned understand(s) and agree(s) that PG&E has received no notice of any liens or
<br />claims against the payment and/or causes of action referred to herein, either from medical providers,
<br />insurance carriers, workers' compensation carriers, other public or private providers such as MediCal,
<br />MediCare, Kaiser, or other HMO or other health plans or any other person or entity. If any such liens or
<br />claims do exist, the undersigned acknowledge(s) and agree(s) that he are (is) solely responsible for payment
<br />of those related to the person of the undersigned, and further, he agree(s) to defend and hold PG&E
<br />harmless with respect to any such liens or claims.
<br />The undersigned agrees(s) to indemnify and hold harmless PG&E from any loss, incurred by PG&E
<br />directly or indirectly by reason of the deliberate falsity of any representation herein by the undersigned.
<br />The undersigned represents that there are no assignments in law or equity, or otherwise, of or
<br />against the claims or causes of action released by him herein; and that he are (is) fully entitled to give this
<br />General Release and discharge.
