Motion carried on roll call vote, Councilman <br />Petersen being noted absent. <br />Mayor Herkner thanked all of City Staff, Planning Commission, Park and Recreation <br />Commission, and Citizens Committee who particpated in preparation of the Plan for <br />park and recreation needs of City, its excellence having been as noted by the <br />Association of Bay Area Governments. (Mayor Herkner asked that a copy of the ABAG <br />communication be sent to all Council members) <br />REPORT OF BID OPENING, Cast Iron and Ductile IroA Water Pipe requirements for period <br />April 1, 1967 -March 31, 1968. The following bids were received: <br />Pacific States Cast Iron Pipe Co. $26,426.20 <br />United States Pipe & Foundry Co. 26,777.25 <br />Staff report stated Pacific States failed to include 4% Sales Tax in their bid, <br />but that communication received since bid opening from this Company acknowledging <br />this omission, had indicated they would be pleased to abide by whatever decision <br />the Council might make. (Copy previously submitted to Council) Staff recommended <br />award be made to Pacific States. <br />Councilman Rosselli moved to adopt RESOLUTION N0, 5337 AWARDING CONTRACT FOR <br />FURNISHING CAST IRON AND DUCTILE IRON WATER PIPE REQUIREMENTS FOR THE PERIOD <br />APRIL 1, 1967 - MARCH 31, 1968 (Pacific States) REJECTING ALL OTHER BIDS RECEIVED <br />AND AUTHORIZING EXECUTION OF AGREEMENT THEREFOR, seconded by Councilman Granger. <br />Councilman Bury questioned omission of 4% Sales Tax and more information on Staff <br />recommendation. <br />City Manager advised Staff recommended award to Pacific States on their bid as <br />submitted. Councilman Granger stated his action favoring award to this Company <br />based on Staff recommendation and assurance by City Attorney that bid award as <br />recommended was legal. Councilman Keckley questioned whether bid could be res- <br />cinded by Company and was advised situations were possible for a Company to with- <br />draw their bid but communication received from Company on this particular bid had <br />clearly indicated they did not intend to ask for a withdrawal but had indicated <br />their pleasure to abide by Council's decision. Councilman Keckley indicated his <br />favoring their chance to withdraw their bid, if Company so desired.
