Minutes of Regular Meeting <br />Redwood City Council <br />August 21, 1967 7:30 P. M. <br />Pledge of Allegiance led by Councilman Bury. <br />Invocation led by Monsignor Joseph D. Munier, Mt. Carmel Catholic Church. <br />ON ROLL CALL the following were noted present: Councilmen Robert H. Bury, Floyd D. <br />Granger, Paul C. Keckley, Herbert G. Petersen, John S. Rosselli, Mayor Sidney D. <br />Herkner and City Clerk Helen C. Moore. Councilman Mary W. Henderson noted absent, <br />Also noted present were City Manager Howard C. Ullrich, Assistant City Attorney <br />William Keiser, Assistant City Manager Henry V. Burget, Police Chief William Faul- <br />stich, Fire Chief J. L. Lodi, Director of Public Works J. Louis Scherer, and Deputy <br />City Clerk Marian McCrindle. <br />Councilman Bury moved to approve Minutes of Regular Meeting of August 14, 1967, seconded <br />by Councilman Rosselli and carried. <br />City Manager asked that introduction of ordinance prohibiting parking on E1 Camino Real <br />in the vicinity of Jefferson Avenue be deleted from this Agenda because of need for <br />further Staff review (Memo 8/22/67) <br />Continued PUBLIC HEARING, Weed Abatement Assessments, 1966-67, declared open. Mayor <br />Herkner announced only the four Councilmen who were present at original hearing were <br />eligible to vote on protests for which evidence had been received on August 7th <br />(Councilmen Bury, Granger, Petersen, and Mayor Herkner) but that all Council members <br />might participate in discussion and voting on protests heard at this continued public <br />hearing. The aforementioned four Councilmen only would be able to vote on the <br />Resolution confirming assessments, as having heard testimony on the entire pro- <br />ceedings. Mayor Herkner further outlined guidelines for those present in order <br />that all might be heard. <br />Councilman Rosselli questioned City Attorney whether he could be considered eli- <br />gible to participate on protests heard at previous public hearing inasmuch as he <br />had reviewed all material and Minutes and felt Council had made changes in Code <br />making such procedure allowable when a Council member absent. Assistant City <br />Attorney advised of recent legal cases which had proved a review of a transcript <br />of proceedings of a public hearing was necessary and a Council member, therefore, <br />not qualified by simply reviewing material and Minutes. City Clerk confirmed pro- <br />cedure which had been approved by Council, whereby a. transcript of a public hear- <br />ing could be requested by any Council member who knew in advance of his impending <br />absence for such proceedings. <br />City Clerk outlined the four reports which had been submitted to Council analyzing <br />the protests which had been received, and which protests had also been submitted <br />to Council as follows: (1) Protests on which evidence had been received at the <br />public hearing on August 7, 1967 (only 4 Councilmen present eligible to vote); <br />(2) and (3) Protests received which had not been discussed at hearing of August <br />7th; (4) Supplemental report of further protests received since reports prepared _ <br />for the Council, copies of which were submitted to Council prior to this meeting. <br />Council requested consideration be given to protests at this time on which evi- <br />dence had been taken August 7th (only four Councilmen present eligible to vote) <br />as follows: <br />Price Properties, Inc. 689 Veterans Boulevard <br />Parcels 052-401-070 $456.40 <br />ALC 26, e7 052-411-280 56.00 <br />
