Council was advised previous roll call vote and motion was as follows: <br />"Councilman Granger moved to adopt a Resolution as then prepared by the City Attor- <br />ney, granting the variance with restrictions to the property that this addition to <br />the applicant's premises would never be used as living quarters, and recorded, <br />seconded by Councilman Petersen and tied on roll call vote, Councilmen Bury, Granger <br />and Petersen voting yes, Councilmen Henderson, Keckley and Mayor Herkner voting no, <br />Councilman Rosselli being noted absent. <br />Mr. Brown appeared to assure Council that proposed structure <br />would not be used as living quarters; he would be willing to <br />construct only the back wall and roof, leaving front open, <br />which would at least protect laundry equipment proposed for <br />use in this additional structure. <br />Council discussed points favoring the variance as it could prove to be more of <br />aesthetic value to the neighborhood while providing proper storage and protection <br />of equipment proposed; no fire hazard present; discussion with Chief Building <br />Official and his assurance that no violation of building code would result if pro- <br />posed structure is approved. Discussion was also held concerning variance proce- <br />dures and conditions required by the zoning ordinance before variances could be <br />granted, which were not thought present in this instance and would set a precedent <br />for other similar situations and be granting a special privilege. Mr. Brown was <br />also questioned concerning drain line installation in evidence, and how garage <br />already constructed was approved and when request for a variance had been made. <br />Mr. Brown explained how contractor hired for construction <br />work had been advised connecting structure not allowable <br />under Zoning Ordinance and variance had been requested throught <br />the Planning Commission although garage port had been enclosed <br />as planned. He also stated construction contract had included <br />pipe line for connecting to anticipated laundry room. <br />Discussion also held concerning desirability of variance procedure in the Zoning <br />Ordinance. Councilman Bury moved to grant the variance, with additional condition <br />offered by Mr. Brown, that the west front wall remain open, seconded by Councilman <br />Petersen, and motion lost on roll call vote, Councilmen Bury, Granger and Petersen <br />voting yes, Councilmen Hend3rson, Keckley, Rosselli and Mayor Herkner voting no. <br />Mayor Herkner .ruled motion in effect resulted in denying applicant's appeal for <br />granting of variance. (MINUTE ORDER #67-178) <br />Report and recommendation concerning CATV Franchise. <br />City Manager read his report in full which had been previously submitted to Council, <br />in which he reviewed ordinance adopted by the Council for regulation of CATV service <br />in Redwood City and the applications which had been subsequently received and re- <br />viewed by Council thereafter, with franchise having been granted to Redwood City <br />CATV, Inc., who since have given notification of their inability to accept the <br />franchise granted. City Manager outlined alternatives now possible for Council to <br />consider as follows: <br />(1) Delay or postpone the CATV issue for the foreseeable <br />future -- Staff would not recommend this alternative <br />as there is an existing need for CATV service in <br />certain areas of the City. <br />(2) Reopen the bidding procedure and solicit new proposals <br />--In Staff's opinion, a new procedure to solicit addi- <br />tional proposals is neither justified nor desirable. <br />X07 <br />0 28 '8i <br />
