<br />Invocation led by Reverend Spindt, Messiah Lutheran Church.
<br />ON ROLL CALL the following were noted present: Councilmen Robert H. Bury, Floyd D.
<br />Granger, Mary W. Henderson, Paul C. Keckley, Herbert G. Petersen, John S. Rosselli,
<br />Mayor Sidney D. Herkner and City Clerk Helen C. Moore. Also noted present were
<br />City Manager Howard C. Ullrich, City Attorney Richard E. Gardella, Assistant City
<br />Manager Henry V. Burget, Police Chief William Faulstich, Fire Marshall George Asvos,
<br />Director of Public Works J. Louis Scherer, Senior Planner Speer McClellan, Auditor -
<br />Accountant Jack Ference, Chief Building Official Charles Gyselbrecht, and Deputy
<br />City Clerk Marian McCrindle.
<br />Councilman Granger moved to approve Minutes of Regular Meeting of August 28, 19673
<br />as mailed, seconded by Councilman Petersen and carried.
<br />Mayor Herkner on behalf of Council, presented to Alfredo Pohl, Department of Public
<br />Works, a Certificate awarded by Department of Defense for his completion of a
<br />course of instruction on Fallout Shelter Analysis, and commended employee for his
<br />efforts in completing this instructional course.
<br />PUBLIC HEARING, Resolution of Intention to modify and amend Resolution No. 4169, as
<br />amended, modify assessments, modify engineer's report, SIERRA STREET - PATM
<br />AVENUE EXTENSION IMPROVEMENTS, declared open and affidavits of publication and
<br />mailing ordered filed.
<br />Staff report stated improvements in this District were constructed approximately
<br />3 years ago, but because of questions raised on the spread of assessments which
<br />were taken to court, completion of the District had been delayed. It was also
<br />reported payments to the contractor had been made with the cash received from some
<br />of the property owners during the 30 -day cash payment period, plus an advance by
<br />the City's General Fund. The assessment amounts being considered at this hearing
<br />are those now approved by the Superior Court.
<br />City Clerk read an unsigned letter of protest from Mr. Consani, owner of property
<br />in this District:
<br />E. Consani, 111 Christel Oaks Dr., Scotts Valley, Calif.
<br />original owner of Por. Lot 8, Block E. (Assessment #37) in
<br />this Assessment District, and since having sold a portion
<br />of the parcel based on costs of previous assessment, pro-
<br />tested additional amount now due from previous assessment of
<br />$3,114.79 to present amount of $4,143.91. He also protested
<br />high assessment costs and attempts which he had made for modi-
<br />fication originally because of fact some facilities had al-
<br />ready been in street before further improvements were made.
<br />He also remarked on the fact that he had dedicated property
<br />to the City and had received no credit for it.
<br />Upon questioning of Attorney for the District if written protest could be considered
<br />when not signed and being advised no legal problem existed, Mayor Herkner ruled pro-
<br />test be accepted, if no further objections.
<br />Mr. Clarence Fogel, 1484 Kentfield, owner of property in the
<br />District, (Por. Lot 6, Blk. E -Assessment #44) reported on attempts
<br />made previously to have assessments rechecked before court action
<br />was instituted and stated his satisfaction with the respread now
<br />made by court action.
<br />Edward Wilson, 1504 Kentfield, purchaser of portion of a parcel
<br />since assessment was first levied for the entire parcel front-
<br />ing on Kentfield (Por. Lot 7, Blk. E - Assessment #43) protest-
<br />ing his property now being included in this respread of assess-
<br />ments.
