21� <br />Councilman Rosselli moved to close the public hearing, seconded by Councilman <br />Bury. Chief Building Official assured Council that if the property owner pre- <br />sented reconstruction proposals, that indicated compliance to code and made sub- <br />stantial corrections within the 30 days period, proceedings could be dropped. <br />Councilman Rosselli moved to adopt RESOLUTION NO. 5476 DECLARING STRUCTURE LOCATED <br />AT 420 AVENUE DEL ORA IN THE CITY OF REDWOOD CITY TO BE A PUBLIC NUISANCE, DIREC- <br />TING THE OWNER TO ABATE SAID NUISANCE, AND ORDERING THE EXPENSE OF ABATEMENT TO <br />BE MADE A LIEN UPON THE LAND IN THE EVENT THE NUISANCE IS NOT ABATED BY THE OWNER, <br />seconded by Councilman Bury and carried on roll call vote. <br />REPORT OF BID OPENING, Ralston Parkway, Section 1, and associated temporary road, <br />storm drain, sanitary sewer, and water projects, GID 1-64. The following bids <br />were received: Corrections <br />Bragato Paving Company $657,343.43 $654,902.92 <br />Hood Corporation 792,601.20 <br />McGuire & Hester 818,074.06 805,006.00 <br />Fisk, Firenze & McLean 8441642.70 <br />L. C. Smith Company 851,574.70 <br />Engineer's Estimate $615,731.75 <br />City Manager reported on DMJM's analysis of bids received for above project and <br />the errors found in their examination of the various schedules making the corrected <br />figures indicated above, with their recommendation that the low bid of Bragato Paving <br />Company be accepted in the corrected amount. He further reported since evaluation <br />and recommendation had been made by DMJM a written communication had been received <br />from Bragato Paving Co. reciting the deficiency errors made in their bid which <br />involved a great deal of money and asking that they be allowed to withdraw their <br />bid as a severe financial loss would result should the bid be awarded to them. <br />Communication was read in full in which a report was made on each of the errors made <br />in the various schedules and corrected amounts given indicating a deficiency of <br />$703565.75. City Manager reported a meeting had been held with City Staff, DMJM <br />representatives, and Bragato Paving Company, and errors checked were found to be <br />substantially as claimed, and agreement by Staff reached thereafter to recommend <br />to Council that all bids be rejected and authorization be given to readvertise the <br />same construction work immediately. <br />City Attorney was asked effect if Council refused to allow withdrawal of the <br />apparent low bidder and awarded bid. He advised this was not entirely within Council's <br />control if bid had been checked and error found to be an honest clerical one, bidder <br />has the right to rescind his bid, and bid could only be denied if error is found to be <br />fraudulent. City Attorney advised recommendation of Staff to accept requested with- <br />drawal of this Company's bid was in order, and that he had been present at the <br />Staff meeting concerning checking of the errors. <br />Councilman Bury moved to accept City Manager's report and recommendation that Council <br />reject all bids and authorize readvertising. <br />Councilman Bury moved to adopt RESOLUTION NO. 5477 REJECTING ALL BIDS RECEIVED FOR <br />CONSTRUCTION OF PARKWAY -1 AND ASSOCIATED TEMPORARY ROAD STORM DRAIN, SANITARY SEWER, <br />AND WATER PROJECTS FOR REDWOOD CITY GENERAL IMPROVEMENT DISTRICT NO. 1-64; DIRECTING <br />RETURN OF SECURITY DEPOSIT; AND, DIRECTING CITY CLERK TO READVERTISE FOR BIDS FOR <br />PERFORMANCE OF SAID WORK, seconded by Councilman Rosselli. <br />su 11 'BT <br />
