l(✓ ' _ <br /> ������ . <br /> �c <br /> a <br /> T�r �he �ona�bl�e �1a��r.��d °��ty <br /> F�m the �� Man�g�r <br /> September 13, 2004 <br /> Subject <br /> Approval of Agreement for Construction of Improvements for 1250 Jefferson Avenue <br /> Recommendation <br /> Approve and authorize execution of construction improvement agreement with Whole <br /> Foods Market Northern Pacific, for constructions improvements for 1250 Jefferson <br /> Avenue. <br /> Background <br /> On May 24, 2004, the City approved both the Use and Architectural Permits for Whole <br /> Foods Market Northern Pacific to re-occupy a 37,600 square foot vacant grocery store <br /> building with a new grocery store, and construct a 1,400 square foot addition to the store <br /> area at 1250 Jefferson Avenue. The building is located at the intersection of EI Camino <br /> Real and Jefferson Avenue. The Permits' conditions require the developer to construct <br /> certain public works improvements to provide services to the new building, and to protect <br /> the general welfare of the public. Improvements to be installed include a curb opening in <br /> the median island at Jefferson Avenue, so that vehicles exiting the site on Adam's Street <br /> can make a left turn onto Jefferson Avenue. Also, the driveway entrance to the site off EI <br /> Camino Real will be made narrower to restrict the opening, thus allowing only entering <br /> vehicles. <br /> Engineering & Construction has approved the plans for the improvements submitted by <br /> the developer, Whole Foods Market Northern Pacific, and their civil engineering <br /> consuttant firm, BKF Engineers, Surveyors, & Planners. <br /> According to Section 29.95, Article VII, Chapter 29 of the City Code, a Construction <br /> Improvement Agreement with the City is required. The developer is required to post <br /> Faithful Performance and Payment Bonds, or appropriate security, each in the amount of <br /> $66,000. <br /> A complete copy of the Construction Agreement is available for review in the City Clerk's <br /> Office. <br /> Fiscal Impacts <br /> Funds for the construction are being provided by Whole Foods Market Northern Pacific. <br /> The Public Works Services Department will maintain the improvements, subsequent to <br /> the acceptance of the project by the City Council. <br /> � ��'�'� � �-2'G' r <br /> Richard Haygood J I erson , d Evere <br /> Senior Civil Engineer o unity Development Services Director City Manager <br />
