RESOLUTION NO. 17-__ <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />REDWOOD CITY APPROVING A GROUND LEASE AND AMENDMENT TO JOINT USE <br />AGREEMENT AND AUTHORIZING CITY MANAGER TO EXECUTE THE AGREEMENTS <br /> <br />WHEREAS, The City of Redwood City (City) owns a plot of real property located at 797 <br />Redwood Shores Parkway (the “Property”); and <br /> <br />WHEREAS, the Belmont-Redwood Shores School District owns a plot of real property in <br />the City located at 801 Redwood Shores Parkway (the “District Property”) and operates <br />Sandpiper Elementary School at such District Property; <br /> <br />WHEREAS, the Property and the District Property together comprise the “Sandpiper <br />Joint-Use Site”; <br /> <br />WHEREAS, the City and District entered into a Joint Use Agreement on June 9, 1995 for <br />the joint use of the Sandpiper Joint-Use Site; and <br /> <br />WHEREAS, the Belmont-Redwood Shores School District (District) seeks disposition of <br />City property in order to develop a new 13,000 square foot two-story classroom building on City- <br />owned property to accommodate grades K-8 for Sandpiper School and seeks to enter into a <br />Ground Lease (attached hereto as Exhibit A and incorporated herein by reference) for the <br />purpose of constructing and operating the new classroom building; <br /> <br />WHEREAS, the District proposes to construct and dedicate to the City a new, relocated <br />child care play area, a new restroom facility, and a new trash enclosure in connection with the <br />Ground Lease; <br /> <br />WHEREAS, the District proposes to enter into an amendment to the Joint Use <br />Agreement with the City related to the use of the new classroom building and other uses on the <br />Sandpiper Joint-Use Site (attached hereto as Exhibit B and incorporated herein by <br />reference)(entry into the Ground Lease and the Amendment to the Joint Use Agreement, <br />together, the “Project”); and <br /> <br /> <br /> <br />WHEREAS, on January 23, 2017, the City Council conducted a public hearing, in <br />accordance with all applicable requirements of the State Planning and Zoning Law, the <br />Redwood City Municipal Code and the Redwood City Zoning Ordinance and (a) approved an <br />Initial Study and Mitigated Negative Declaration and (b) approved a General Plan Amendment, <br />each relating to the proposed Ground Lease; <br /> <br />WHEREAS, entry into the Ground Lease and the Amendment to the Joint Use <br />Agreement is in the best interests of the City. <br /> <br />NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: <br /> <br />Section 1. The City Council finds that the above recitals are accurate and constitute findings in <br />this matter and, together with the Staff Report and the application materials, development plan, <br />and all other documents, reports, studies, memoranda, maps, oral and written testimony, and <br />7.A. - Page 151
