The <br />report shall be submitted to the project applicant, the City Planning <br />Department, and the NWIC. Once the report is reviewed and approved by <br />the City Planning Department, and any appropriate treatment completed, <br />project construction activity within the area of the find may resume. <br />b. If the MLD does not make recommendations within 48 hours the project <br />applicant(s) shall reinter the remains in an area of the property secure from <br />further disturbance. If the project applicant(s) does not accept the MLD`s <br />recommendations, the applicant(s) or the MLD may request mediation by <br />the NAHC. (Mitigation Measure 4.5-3a) <br />65. Training for Cultural, Previously Undiscovered Archaeological, and Human <br />Remains Resources — Prior to the issuance of grading permits within the plan area, the <br />City Planning, Housing, and Economic Development Department shall confirm that any <br />development applicant has required all construction crews to undergo a training session <br />to inform them of the presence and nature of federal or state -eligible cultural resources <br />and the potential for previously undiscovered archaeological resources and human <br />remains within the project area, of the laws protecting these resources and associated <br />penalties, and of the procedures to follow should they discover cultural resources during <br />project -related work. (Mitigation Measure 4.5-3b) <br />Other Aoencv Permits <br />66. Caltrans — If a portion of the proposed work is within the State of California right-of-way <br />(Woodside Road, EI Camino Real), the applicant shall contact the California Department <br />of Transportation (Caltrans) at (510) 286-4417 to obtain all necessary Encroachment <br />Permits. [SDR][ENGINEERING] <br />General Requirements <br />67. Exterior Materials — The exterior materials, colors, textures, trim elements, windows <br />and roof pitch of the project shall be consistent throughout and substantially conform to <br />the colors and plans, date received August 30, 2016, on file with Planning Services. <br />[COA][PLANNING] <br />68. Review of Modifications — Modifications to the approved plans require Planning review <br />and approval prior to building permit issuance. Substantial modification of approved <br />plans, as determined by the Zoning Administrator, may be subject to an amendment or <br />a new Permit. [COA][PLANNING] <br />69. Residential Noise Notice — The applicant, property owner, or property manager shall <br />notify owners or tenants, in writing, before an owner or tenant takes residence that they <br />will be living in an urban -type environment and that they noise levels may be higher than <br />a strictly residential area. The covenants, conditions, and restrictions of a residential or <br />mixed-use project shall require that prospective residents acknowledge the receipt and <br />understanding of this information.
