impacts to historical resources from these actions are anticipated. This section will <br />assess the adequacy of previously identified baseline condition information generated <br />by the environmental review for the IHSP to serve as a basis for the analysis in this <br />scope of work; the section will also recommend mitigation measures, as appropriate, to <br />ensure that potential impacts to prehistoric or historic cultural resources would be <br />avoided or minimized. As part of this scope of work, CONSULTANT recommends, and <br />has included in this scope of work, an update to the record search previously <br />conducted. <br />As an optional task, CONSULTANT can assist the CITY in complying with the <br />provisions of AB 52, a law recently passed by the California Legislature regarding tribal <br />consultation. AB 52 provides for consultation with Native American tribal organizations <br />during the CEQA process. Prior to release of a Negative Declaration, Mitigated <br />Negative Declaration or Environmental Impact Report for a project, a lead agency must <br />provide the opportunity to consult to tribes that are traditionally and culturally affiliated <br />with the geographic area in which a project is located, and must conduct such consulta- <br />tion, if requested by the tribes in writing within 30 days of notification of the proposed <br />project. CONSULTANT will conduct the following items: <br />1. Request from the Native American Heritage Commission (NAHC) a contact list for <br />pertinent tribes and provide a draft of the County's AB 52 notification letter to tribes <br />for use on official letterhead; and <br />2. Attend up to two four (4) hour AB 52 consultation meetings with the CITY and tribal <br />representatives to provide technical input. <br />Because accidental discovery of cultural resources is a possibility whenever ground - <br />disturbing activities are conducted, mitigation measures may be recommended for <br />accidental discovery of paleontological and archaeological resources during subsurface <br />construction activities. CONSULTANT will review the CITY's General Plan and other <br />relevant planning documents to identify the likelihood of accidental discovery of these <br />resources. <br />6. Geology and Soils <br />As described in the IHSP Draft Technical Memorandum, soils in the vicinity of the <br />project site consist of alluvial deposits overlain by a soft to very stiff marine clay deposit <br />("Bay Mud"). Bay Mud is considered to be a highly compressible material and subject to <br />differential settlements. The geology and soils section will summarize the potential for <br />geologic impacts based on information available regional and site-specific geotechnical <br />information. Based on review of the IHSP Draft EIR, BASELINE will determine if the <br />analysis (and any mitigation) included in the Draft EIR adequately addresses project - <br />level issues related to earthquakes, landslides, and unstable soil conditions, including <br />erosion and shrink -swell soils.
