REPORT <br />To the Honorable Mayor and City Council <br />From the City Manager <br /> <br />February 13, 2017 <br />SUBJECT <br />Agreement with MuniServices LLC <br /> <br />RECOMMENDATION <br />By motion, approve and authorize the City Manager to execute a three-year Agreement <br />in an amount of up to $200,000 for a Utility Users Tax Compliance and Revenue <br />Protection Program with MuniServices, LLC; and authorize the City Manager to extend <br />the Agreement by two additional one-year terms in an amount not to exceed $66,000 <br />per year <br /> <br />BACKGROUND <br />The City levies local taxes on the use of gas, electricity, communications, and prepaid <br />wireless. The City has engaged MuniServices to provide Utility Users Tax (UUT) <br />Compliance and Revenue Protection Program services since 1994. Staff is unaware of <br />other vendors providing similar services, and has been satisfied with the technical <br />information provided by MuniServices. <br /> <br />ANALYSIS <br />The purpose of the recommended Council action is to renew the MuniServices contract. <br />MuniServices will provide the following services under the agreement: <br /> <br />· Compliance, administrative oversight <br />· Revenue protection and enhancement <br />· Ordinance review <br />· Administrative rulings <br />· Tax inquiries services <br /> <br />These services enable the City to preserve, protect and enhance UUT revenues. <br /> <br />Under the contract, MuniServices will assist the City with the requirements for collecting <br />UUT under AB1717. On August 24, 2015, the Council approved a resolution required <br />under AB1717 that allows MuniServices to access Board of Equalization documents <br />related to retailers’ taxes for Prepaid Wireless (Resolution No. 15439). <br /> <br />MuniServices provides UUT audit services for over 60 public agencies in California, <br />representing approximately 70% of all UUT revenues collected in the state. With over <br />20 years’ experience, MuniServices has developed extensive data management <br />resources that facilitate finding new revenue sources for clients.
