April 1990 to Barbara Lawrence, Executive Director of the Midpeninsula <br />Citizens for Fair Housing and James Hartnett, Chairman of the Housing and <br />Human Concerns Committee. Ms. Lawrence invited everyone to attend the 25th <br />Anniversary celebration on May 6, 1990, 5 -7 p.m. at the 1st Presbyterian <br />Church in Palo Alto. <br />-------------------------------------------------------------------------- - - - - -- <br />3. PUBLIC HEARING - appeal of the zoning administrator's approval for a planned <br />development permit under Article 46 of the zoning ordinance to construct 12 <br />townhomes at 1575 Oxford Street - Nathaniel Flynn, appellant (203 -10) <br />Affidavits of publication are on file in the City Clerk Department. <br />Report: Planning Director, April 23, 1990 <br />Planning Director Patterson presented the staff report describing each <br />of the appellant's bases for appeal and the staff responses. <br />Mayor La Berge declared the Public Hearing open at 7:50 p.m. and invited <br />anyone who wished to speak to do so. <br />Nathaniel E. Flynn, 2805 Adeline Drive, Burlingame, owner of adjoining <br />property at 1548 Hudson Street, described the impacts of the proposed <br />townhouse project on his property using charts, diagrams, and a mock -up. <br />Mr. Flynn suggested angling the units across the back of the lot to mitigate <br />the noise, lack of privacy and shadows cast upon his pool and that he was <br />entitled to certain property rights including the sunlight on his pool. <br />Planning Director Patterson described the problems with Mr. Flynn's <br />suggested alternative including fire access interference and danger to <br />heritage trees, and described how the proposed project exceeds set backs and <br />is well within all zoning and architectural requirements. <br />Gary Ernst, 2414 Lake Blvd., Redwood City, developer of 1575 Oxford Street <br />spoke in favor of his project and the additional steps he has taken to <br />ensure a quality development. <br />In response to Council questions City Attorney Schricker advised there are <br />no inherent property rights to sunlight over a pool. <br />In response to Council concerns Planning Director Patterson advised the <br />Planning Commission has been discussing set backs and other requirements and <br />will be holding a Public hearing on these issues before bringing their <br />recommendations to Council. <br />MEMO 4/24/90 <br />M /S: Stangel /Murray to close the Public Hearing. <br />Carried by unanimous voice vote and Public Hearing closed at 8:22 p.m. <br />MINUTE BOOK NO. 49 <br />Page No. 277 Reg.
