3. City may, but is not required to, increase this Amendment by up to fifty thousand dollars ($50,000) for the addition of cost-shared pruning services of street trees in front of private properties. 4. Contractor will complete all work described in Exhibit "A" by August 31, 2005. 5. All other provisions of the Agreement, as may have been amended from time to time, will remain in full force and effect. 6. The Parties hereby ratify the actions taken by the City Council on August 11, 2002 and August 25, 2003, and adopt them as formal amendments to the Agreement. 7. All requisite insurance policies to be maintained by Contractor pursuant to the Agreement, as may have been amended from time to time, will include coverage for this Amendment and those amendments authorized by the City Council on August 11, 2002 and August 25, 2003. 8. The individuals executing this Amendment and the instruments referenced in it on behalf of Contractor each represent and warrant that they have the legal power, right and actual authority to bind Contractor to the terms and conditions of this Amendment.
