10 <br />implemented outside of a CalPERS contract amendment as authorized by <br />Government Code Section 20516(f), and shall extend beyond the <br />expiration of this Agreement and establish the status quo for purposes of <br />future negotiations. This entire subsection A. of 13.3.1 shall terminate <br />upon the amendment of the City’s contract with CalPERS as stated under <br />subsection B. of 13.3.1. <br /> <br />B. 9% Cost Sharing Under Combined Contract Amendment and 20516(f) <br /> 1. 3% Cost Sharing By CalPERS Contract Amendment <br />Effective as soon as administratively feasible after ratification and <br />Council approval of a tentative agreement, but no later than <br />October 1, 2017, in addition to paying the required member <br />contribution of 9%, members covered by Tier 1 (3%@50), and <br />Tier 2 (3%@55), shall pay, through payroll deduction, an <br />additional 3% of compensation earnable toward the City’s normal <br />cost of pension benefits as permitted by Government Code <br />20516(a). The parties acknowledge that CalPERS mandates an <br />election of unit members, separate from ratification of this <br />Agreement, to provide for this cost sharing pursuant to <br />Government Code Section 20516. As soon as practicable after <br />the effective date of this Agreement, the City will initiate the <br />contract amendment process. Upon approval and agreement <br />from the bargaining unit and completion of the City’s amendment <br />to the CalPERS contract, employee contributions will be made <br />pursuant to Government Code Section 20516(a), Unit Member <br />Cost Sharing of Additional Benefits. The COA and the City will <br />take all actions necessary to implement the pension cost sharing <br />agreement described in this paragraph. In the event the City’s <br />contract with CalPERS is not amended by October 1, 2017, the <br />10% cost sharing described in subsection A. of 13.3.1 shall be <br />reduced by 1% to 9%. <br /> <br /> 2. 6% Cost Sharing under Government Code 20516(f) <br />Concurrent with effective date of the amendment of the City’s <br />contract with CalPERS under 13.3.1.B.1. above, each unit <br />member shall contribute an additional six percent (6%) of <br />compensation earnable toward the employer cost of retirement <br />pursuant to Section 20516(f) of the California Government Code. <br />Pursuant to subsections B.1. and B.2. of 13.3.1, members shall <br />contribute a total of 9% of compensation earnable towards the <br />employers cost plus 9% of compensation earnable towards the <br />required member contribution, for a total member contribution of <br />18%. <br /> <br /> <br />6.3.B. - Page 91
