22 <br />(56) hour schedule exceeds 1200 hours, the city will cash out sick leave in <br />excess of 1200 hours at a fifty percent (50%) rate. <br /> <br />16.1.4 In the event an employee has accumulated the maximum sick leave credits of <br />one-thousand two-hundred (1200) hours (2400 hours for Battalion Chiefs) and <br />the employee becomes so severely ill that he or she exhausts his or her sick <br />leave, the Personnel Officer may, upon the written recommendation from the <br />employee's Fire Chief, authorize additional sick leave to include any sick leave in <br />excess of the one-thousand two-hundred (1200) hours (2400 hours for Battalion <br />Chiefs who work a fifty-six (56) hour work week) maximum which may have been <br />lost due to the maximum limitation; provided, however, that sick leave credits <br />were not accumulated for a period of six (6) months or longer. This provision will <br />also apply to Battalion Chiefs in cases where sick leave balances were <br />decreased due to reassignment from a fifty-six (56) hour to a forty (40) hour work <br />week. <br /> <br /> 16.1.5 An employee may elect to receive compensation in lieu of sick leave credits for <br />any calendar year (based on the first 26 pay periods ending that year) by <br />requesting payment of unused sick leave in writing to the Director of Finance on <br />or before December 1 of the prior year. Payment shall be made at twenty-five <br />(25%) of the value of the unused sick leave, or fifty percent (50%) of the value of <br />the unused sick leave when no more than ten (10) hours of sick leave have been <br />used (24 hours for Shift Battalion Chiefs) for the preceding year at the salary for <br />the year in which the payment is being made. (Battalion Chiefs assigned to a 40- <br />hour schedule shall have leave paid out at the corresponding 56-hour rate). <br />Payment shall be made after December 31. There shall be no payment in lieu of <br />accumulated sick leave benefits for years prior to such calendar year. Use of <br />Personal Business Leave shall be excluded from the definition of sick leave for <br />the purposes of this section. <br /> <br /> 16.1.6 Accumulated sick leave credits shall be reduced by the value of the sick leave <br />compensated as provided in the above paragraph and the remaining balance <br />shall be accumulated to a maximum of one-thousand two-hundred (1200) hours <br />(2400 hours for Battalion Chiefs who work a fifty-six (56) hour work week). <br /> <br /> 16.1.7 If an employee terminates his or her employment, for reasons other than death, <br />retirement or discharge, compensation in lieu of unused sick leave shall be paid <br />in accordance with the terms provided for an employee who may elect to receive <br />compensation in lieu of sick leave credits in accordance with Section 16.1.5, <br />prorated to the date of termination of service. Employees who have ten (10) <br />years of service and who retire from City employment with benefits from <br />CalPERS or who die while in the employ of the City shall be eligible to receive: <br />A) compensation in lieu of unused in accordance with the terms provided for an <br />employee who may elect to receive compensation in lieu of sick leave credits, <br />prorated to the date of termination of service; and B) fifty percent (50%) of <br />remaining accrued unused sick leave. In the event of the death of an employee, <br />such payments shall be made to the designated beneficiary filed with the Director <br />of Finance, or, in the event no designated beneficiary has been chosen, the <br />beneficiary listed in the employee's insurance policy will receive the payment of <br />such unused sick leave as provided under the provisions for an employee who <br />6.3.B. - Page 103
