26 <br />· Testifying on his or her own behalf; <br />· In preparation for the trial, including answering the government’s interrogatories, and <br />observing the conduct of the trial, if an employee is a party in a suit against the City <br />(i.e., plaintiff); <br />· If summoned for a criminal or traffic violation in connection with his or her appearance <br />in court as a defendant; <br />· If the employee brings or responds to a suit, or is summoned to provide testimony in a <br />nonofficial capacity, in a proceeding to which the City is not party; or <br />· In court if appearing voluntarily. <br /> <br />16.11 Personal Business Leave <br /> <br />16.11.1 Personal Business is defined as business of urgent and compelling importance <br />which cannot be taken care of outside of normal working hours and which is not <br />covered under other leave provisions of this Memorandum of Understanding. <br /> <br />16.11.2 An employee shall be entitled to a maximum of two (2) days per year for <br />Personal Business Leave for any reason without loss of pay. Such leave shall <br />be deducted from accrued sick leave. <br /> <br /> 16.11.3 An employee must secure advance permission for all Personal Business Leave <br />as defined above, and shall normally notify the Fire Chief two (2) days before <br />taking this leave, unless any emergency exists which prohibits the employee <br />from providing such advance notice. <br /> <br /> <br />ARTICLE 17 <br /> <br />HEALTH PLANS <br /> <br />17.1 Health and Cafeteria Plans <br /> <br /> 17.1.1 The City agrees to contract with the California Public Employee's Retirement <br />System (CalPERS) for participation under the Public Employees Medical and <br />Hospital Care Act (Government Code Section 22750, et, seq.), for the purpose of <br />providing medical insurance benefits for employees and qualifying annuitants, <br />pursuant specifically to Government Code Section 22825 and 22850. Upon the <br />request of the City, the parties will re-open this Article 17.1.1 to meet and confer <br />on modifying 17.1.1 to provide a different group health plan. <br /> <br />17.1.2 The City’s maximum contribution for each eligible, active employee for a Health <br />Benefits Plan (as referenced in Government Code 22825) shall not exceed the <br />CalPERS minimum contribution, and shall be adjusted annually by the PERS <br />board to reflect any change to the medical care component of the Consumer <br />Price Index and shall be rounded to the nearest dollar. <br /> <br /> 17.1.3 In the event there are any costs not charged to the City due to delays by PERS <br />and/or other administrative agencies in calculating or reporting these costs, said <br />costs shall be carried over and charged as administrative costs to the following <br />plan year and deducted from the aforementioned monthly dollar caps <br />accordingly. <br />6.3.B. - Page 107
