�. - i <br /> �� <br /> 3. That Paragraph 4 of Resolution No 6882 is hereby amended to read as <br /> follows: <br /> "4. Fee Schedule. (a) Fee for Initial Studv. Neyative Declaration. <br /> For any proposed project defined in paragraph 2(r) (i) (3) hereof, which is <br /> not subject to a categorical or emergency exemption, an applicant shall <br /> pay a non-refundable fee of $1,500 for an initial study to determine <br /> whether the proposed project may have a significant effect on the <br /> environment. In the event it is determined that a notice of exemption shall <br /> be filed, a fee of $100 shall be paid therefore. The fee specified in this <br /> paragraph 4(a) shall be paid at the time the applicant applies to the City <br /> for the issuance of the lease, permit, license, certificate, or other <br /> entitlement for use involved with the proposed project. <br /> (b) Fee for Preparation of a Nepative Declaration. <br /> i. Proiects with a land area of less than one auarter of an acre. In <br /> the event it is determined that a negative declaration is required for the <br /> project and the project consists of less than one quarter of an acre of land <br /> area, no additional fees shall be assessed unless such declaration is to <br /> be prepared by a consultant, in which case Paragraph 4(d) of this <br /> Resolution controls. <br /> ii. Proiects with a land area of one quarter of an acre or more. <br /> In the event it is determined that a negative declaration is required for the <br /> project and the project consists of one quarter of an acre or more of land <br /> area then the provisions of the City Council's Cost Recovery Policy for <br /> Planning Related Major Project Applications adopted on September 27, <br /> 2004, as that policy may be amended from time to time, will apply. <br /> (c) Fee for Preparation of Environmental Impact Report. <br /> i. Proiects with a land area of less than one auarter of an acre. For <br /> a project which consists of less than one quarter of an acre of land and <br /> requires the preparation of an environmental impact report, an applicant <br /> shall pay the actual cost of preparation thereof as hereinafter provided. <br /> Upon determining that an environmental impact report is required for a <br /> project, the Planning Director shall calculate the estimated cost of the <br /> preparation of such report based upon an hourly rate set forth in the City <br /> Council's Cost Recovery Policy for Planning Related Major Project <br /> Applications adopted on September 27, 2004, as that policy may be <br /> amended from time to time. Upon notification of the estimated cost of <br /> preparation of an environmental impact report, and prior to <br /> commencement of work thereon, the applicant shall pay to the City the <br /> total sum so calculated. In the event the actual cost as determined upon <br /> completion of the final environmental impact report exceeds the sum so <br /> deposited, the applicant shall pay the difference upon notification thereof <br /> by the City, and in the event said final cost is less than the amount so <br /> Atty/Reso/Reso.1398 3 <br /> 091604 <br />
