(�.1 _ <br /> 1 <br /> � REPORT <br /> To the Honorable Mayor and City Council <br /> From the City Manager <br /> September 27, 2004 <br /> Subject <br /> Amendment to Agreement for Groundwater Contamination Investigation— Vicinity of EI <br /> Camino Real / Jefferson Avenue <br /> Recommendation <br /> By motion, approve Amendment No. 1 to professional services agreement with MACTEC <br /> Engineering & Consulting, Inc. for environmental engineering services relating to alleged <br /> groundwater contamination and authorize City Attorney to execute same. <br /> Background <br /> This amendment is to continue the investigation, testing and report preparation work <br /> related to the groundwater conditions in the EI Camino Real / Jefferson Avenue area. City <br /> Council first authorized an agreement for such work in September 1996 with the firm, <br /> Subsurface Consultants, Inc. The firm produced a substantial technical report to the San <br /> Francisco Bay Regional Water Quality Control Board (RWQCB) in July 2000. In February <br /> 2002, the City Council terminated the agreement with Subsurface Consultants, when the <br /> project manager moved to the firm Harding ESE. To continue the work, the Council <br /> autho�ized a new agreement with Harding ESE, which subsequently became part of <br /> MACTEC Engineering & Consulting, Inc. <br /> The July 2000 report to RWQCB produced the scope of services for the current phase. <br /> This scope was defined and approved by the RWQCB. The consultant is in the process of <br /> preparing a final report which will be presented to the RWQCB within the next two months. <br /> It will offer conclusions and recommendations for the next phase of the process. <br /> The proposed amendment will increase the agreement value by $8,000.00 and approve <br /> the assignment of the Agreement from Harding ESE to MACTEC Engineering & <br /> Consulting, Inc. The increase is associated with additional meetings and investigative work <br /> and analysis for final report preparation requested by staff. The total contract value <br /> increases from $76,860 to $84,860. <br /> Alternative <br /> This is no practical alternative to increasing the current contract value. The consultant is in <br /> the final stages of producing a report mandated by the RWQCB. <br /> REV. 09/07/2004 <br />
