� � ' D r <br /> 3 <br /> AMENDMENT N0.1 TO AGREEMENT FOR <br /> PROFESSIONAL CONSULTING SERVICES <br /> SOILS INVESTIGATION - EL CAMINO REAL AREA <br /> (MACTEC Engineering & Consulting, Inc.) <br /> This Amendment No. 1 is entered into and effective as of the day of <br /> , 2004, amending the agreement dated 3`� day of April, 2002 (the <br /> "Agreement") by and befinreen the City of Redwood City, a charter city and municipal <br /> corporation ("City"), and HARDING, ESE, doing business as MACTEC Engineering & <br /> Consulting, Inc., ("ConsultanY') (collectively, the "Parties") for soils investigation and <br /> reporting in the vicinity of EI Camino Real in Redwood City, and <br /> RECITALS <br /> A. Paragraph 4 of the Agreement allowed Harding ESE to assign rights and <br /> obligations under the Agreement upon written approval of the City. <br /> B. On or about April 23, 2003, Harding ESE assigned its interest in the <br /> Agreement to Consultant. <br /> C. City consents to the assignment of the interest in the Agreement from <br /> Assignor to Assignee. <br /> D. The Parties desi�e to alter the Agreement's scope of work that will result in <br /> a final report to the Regional Water Quality Control Board. <br /> E. The Parties have negotiated and agreed to continue the scope of work <br /> and fee schedule described in Exhibit "A," Scope of Services and Fee of the Originat <br /> Agreement, which is incorporated herein by this reference. <br /> NOW, THEREFORE, in consideration of these recitals and the mutual covenants . <br /> contained herein, the Parties agree as follows: <br /> 1. Consultant, as of April 23, 2003, assumes all of Harding ESE's rights and <br /> obligations as set forth in the Agreement. <br /> 2. City hereby agrees and consents to the assignment of all of Harding ESE's rights <br /> and obligations as set forth in the Agreement to MACTEC Engineering & <br /> Consulting, Inc. <br /> 3. In addition to those services contained in the Agreement, as may have been <br /> amended from time to time, Consultant will provide those services described in <br /> Exhibit "A, Scope of Services and Fee of the Original Agreement. <br /> 4. City will pay Consultant Eight Thousand and no/dollars ($8,000.00) to continue <br /> the scope of services described in Exhibit "A, Scope of Services and Fee of the <br /> Atty/Agr/Amendments/AmendMACTEC 1 <br /> 090904 j 1 <br />
