AMENDMENT NO. 1 TO REVOCABLE LICENSE AGREEMENT [DASARO'S, LLC] THIS AMENDMENT NO. 1 is made and entered into this ~.. day of ~/'~.mjust;'2~02, by and between the City of Redwood City, a charter city and municipal corporation of the State of California ("City") and Dasaro's LLC ("Licensee") RECITALS WHEREAS, on February 12, 2002, Licensee obtained a Revocable License by Agreement with the City of Redwood City (the "Agreement") to use a portion of City Hall Plaza for outdoor seating, tables and limited related improvements for the outdoor restaurant and caf6; and WHEREAS, Licensee is now requesting an amendment to the Agreement for the installation of a small (90 square foot) portable flower stand (the "Flower Stand"); and WHEREAS, City has determined that the Flower Stand is compatible with sidewalk cafes and is expected to further enliven pedestrian experience in the public space which would otherwise remain empty; and WHEREAS, on August 13, 2002, the Architectural Review Committee approved the proposed design of the Flower Stand. NOW, THEREFORE, the parties agree to amend the Agreement as follows: 1. The definition of "Improvements" contained in recital D of the Agreement is hereby amended to include the Flower Stand as specified in the Plans approved by the Architectural Review Committee on August 13, 2002, and attached hereto as Exhibit "A." 2. The City reserves the dght to rearrange the proposed location of the Flower Stand if it is determined by City that fhe structure interferes with public use, access and/or enjoyment of the space. 3.
