<br /> DES:dft 12/17/90 (028/8) <br /> DES:dft 6/11/93R (016/11) <br /> 6/24/93R <br /> 7/22/93R <br /> Requirement of Law, the User responsible for the <br /> occurrence or condition giving rise to such damages, <br /> the occupant and the owner of the Premises shall be <br /> liable, for the full amount thereof, jointly and <br /> severally, to the Authority and the City, or any other <br /> public agency having incurred such damages. <br /> "Section 27.126. Emergency Termination of <br /> Service. Authority's Manager or City's Director, as <br /> applicable, are hereby authorized and empowered <br /> immediately to terminate sanitary sewage service to any <br /> Premises for the purpose of halting or preventing any <br /> discharge into the Sewerage Facilities which <br /> Authority's Manager or City's Director, as applicable, <br /> reasonably determines to constitute a Detrimental <br /> Discharge, or otherwise significantly imperils the <br /> public health, safety or welfare. In such case, <br /> Authority's Manager or said City's Director, as <br /> applicable, shall make a reasonable effort to notify <br /> the User and/or the owner of the Premises prior to <br /> halting or preventing such discharge; provided, <br /> however, that the failure of the User or owner to <br /> receive such notice shall not affect any action taken <br /> hereunder, so long as the determination of detrimental <br /> discharge or imperilment of the public health, safety <br /> or welfare made by Authority's Manager or City's <br /> Director, as applicable, was reasonable and made in <br /> good faith. <br /> 79 <br />
