ORIGINAL <br />AMENDMENT TO JOINT USE AGREEMENT BETWEEN <br />THE CITY OF REDWOOD CITY AND THE BELMONT-REDWOOD SHORES <br />SCHOOL DISTRICT REGARDING JOINT USE OF THE SANDPIPER PARK SITE <br />This Agreement is made this a day of 2017, by and between <br />the CITY OF REDWOOD CITY, a municipal corporation of the tate of California ("City") <br />and the Belmont -Redwood Shores School District, a public school district in the County <br />of San Mateo ("District"). <br />RECITALS <br />A. City is the owner of certain real property located within the City of Redwood <br />City, County of San Mateo, State of California, as more particularly described in Exhibit <br />A attached hereto ("Sandpiper Park"). <br />B. District is the owner of certain real property located within the City of <br />Redwood City, County of San Mateo, State of California, described in Exhibit B attached <br />hereto ("Sandpiper School Property"), upon which District operates Sandpiper <br />Elementary School ("Sandpiper School"). <br />C. City and District (the "parties"), on or about June 9, 1995, entered into an <br />Agreement for Joint Use of the Sandpiper Park Site ("Agreement"), attached hereto as <br />Exhibit C, affecting the property identified in Exhibits A and B ("Sandpiper Joint Use Site"). <br />Since entering into the Agreement, the Sandpiper Joint Use Site has been jointly, <br />beneficially, and continually used by the parties for park and school purposes. <br />D. To accommodate projected growth and reduce overcrowding, District <br />wishes to expand Sandpiper School by constructing, at its expense, and operating a new <br />District -owned classroom building ("New Classroom Building") on a certain portion of <br />City -owned real property located within the Sandpiper Joint Use Site, as more particularly <br />described and shown in Exhibit D attached hereto (the "Premises"). Upon completion of <br />the New Classroom Building, it is projected that Sandpiper School will serve a total of <br />approximately 786 K-8 District students, a significant proportion of whom will be residents <br />of Redwood City who reside near Sandpiper School. <br />E. City wishes to make the Premises available to District, through a long-term <br />ground lease, for purposes of constructing and operating Sandpiper School including but <br />not limited to the New Classroom Building. In partial consideration for District's use of the <br />Premises, City and District wish to make certain amendments, as detailed below, to the <br />Agreement. <br />NOW, THEREFORE, in consideration of the terms, conditions, and covenants <br />herein, the Parties agree as follows: <br />ATTY/AGR/2017/AMENDMENTS/AMEND NO. 1 TO JOINT USE AGREEMENT- SANDPIPER <br />REV: 03-02-17 JS Page 1 of 42 <br />
