<br /> DAL:dft lc)/26/90 (026/8) <br /> /Ol/90R <br /> WHEREAS, Centrum V and Centrum IV each subsequently conveyed <br />a fee interest in its respective parcel to Oracle, and, addition, <br />Centrum Owners is the beneficial owner of various easements on <br />the Property and is the owner of the common areas of the <br />Property; and <br /> WHEREAS, Centrum, Oracle, Centrum III, and Centrum OWners, <br />as successors in interest to Campeau, have been assigned and have <br />assumed the rights and obligations of Developer under the <br />Development Agreement; and <br /> WHEREAS, subsequent to the execution of the Development <br />Agreement, the development plan for the Project described in <br />Exhibit "B" to the Development Agreement was updated and replaced <br />by the development plan attached as Exhibit "B" to the Amendment <br />to Development Agreement; and <br /> WHEREAS, the original Planned Development Permit PD-10307-4, <br />as amended by PD-10303-6, and further amended on May 17, 1988, by <br />PD-10305-8 to modify the design and the building area of the <br />office buildings to be constructed in the Project, was superseded <br />on April 18, 1989 by Planned Development Permit PD-10302-9 which, <br />among other things, modified the height, area and location of the <br />office buildings and increased by 575 parking spaces the 3,000 <br />parking spaces originally authorized in the Development Agreement <br />for the office buildings; and <br /> WHEREAS, the City approved a tentative subdivision map (TM <br />10803-9) to resubdivide the Property to conform to the revised <br />Planned Development Permit, the final map of which was recorded <br /> 2031 <br /> 2 <br />
