And that said Charter of the City of Redwood City be amended
<br />by the addition thereto of new Sections to be numbered as follows,
<br />to -wit;
<br />Section 47, Section 47a, Section 47b, Section 47c, Section
<br />47d, Section 47e, Section 47f, Section 47g, Section 47h, Section
<br />48, Section 48a, Section 48b, lection 48c, Section 48d, Section
<br />48e, Section 48f, Section 48g, Section 49, Section 49a, Section
<br />49b, Section 49c, Section 49d, Section 49e, Section 50, Section
<br />50a, and to read as follows, to -wit:
<br />Section 47. ESTABLISTIMENT
<br />OF A PORT DEPARTMENT: To
<br />promote and more definitely insure
<br />the comprehensive and adequate
<br />development of the Port of Red-
<br />wood City through continuity of
<br />control, management and opera-
<br />tion, there is hereby created a de-
<br />partment of the City of Redwood
<br />City to be known as the "Port
<br />Department"
<br />Section 47a. BOARD OF PORT I
<br />COMMISSIONERS: The exclusive
<br />control and management of the
<br />Port Department is hereby vested
<br />in the Board of Port Commission-
<br />ers, which shall be composed of
<br />five (5) members, who shall be ap-
<br />pointed by the City Manager, sub-
<br />ject to the approval of the Coun-
<br />cil.
<br />No person shall be appointed as
<br />a member of the Board who is
<br />-not at the time of his appointment,
<br />'and has not been continuously for
<br />three (3) years immediately 'pre -
<br />:ceding, a qualified elector of the
<br />'City of Redwood City.
<br />The members of the Board shall
<br />serve without salary or eompenaa-
<br />tion.
<br />Section 47b. ORGANIZATION;
<br />TERMS OF OFFICE: Within thir-
<br />ty (30) days after the ratification
<br />of this amendment by the Legis-
<br />lature, the City Manager shall ap-
<br />point five (5) persons as mem-
<br />bers of the first Board, subject to
<br />the approval of the Council.
<br />The members so appointed shall
<br />immediately organize by the elec-
<br />tion of a President, Vice -President
<br />and Secretary, and make provision
<br />for stated meetings, and shall de.
<br />termine, from time to time, when
<br />and where the Board shall hold
<br />Its meetings, which shall be open)
<br />to the public.
<br />Said persons shall, thereuponj
<br />also cast lots for their respective)
<br />terms:
<br />One (1) of whom shall serve
<br />until the first Monday of July,,
<br />1938.
<br />Two (2) of whom shall serve'
<br />until the first Monday of July,
<br />1940.
<br />Two (2) of whom shall serve
<br />until the first Monday of July,
<br />1942.
<br />At the expiration of the term
<br />of each of said persons so ap-
<br />pointed, their successors shall be
<br />appointed by the City Manager,
<br />subject to the approval of the
<br />Council, for a full term of five
<br />(5) years, except in the case of
<br />a vacancy, in which event the
<br />appointment shall be for the un-
<br />expired term.
<br />Section 47c. REMOVAL: Any
<br />member of the Board may be re-
<br />moved from office on five -seventh
<br />(5/7) vote of, the whole Council.
<br />or by recall as provided in Sec-
<br />tion 0 of this Charter.
<br />Section 47d. ORDINANOE$ AND
<br />RESOLUTIONS: All actions taken
<br />by the. Board of Port Commission-
<br />ers shall be by motion spread upon
<br />its minutes, or by resolution ex-

<br />amounts of the license fees to be
<br />paid to the city by any such per-
<br />son, firm or corporation, operat-
<br />ing any such public service or
<br />utility, and the rates or tolls to be
<br />charged and collected for service
<br />furnished or supplied by such pub-
<br />lic service or utility shall be fixed
<br />by the Board by ordinance.
<br />(7) To fix all rates, dockage,
<br />rentals, tolls, pilotage, wharfage,
<br />and charges, for the use and oc-
<br />cupation of the public facilities
<br />or appliances of the port, and for
<br />services rendered by the Port De-
<br />partment, and to provide for the
<br />collection thereof.
<br />(9) to purchase materials and
<br />supplies without advertising for
<br />bids in an amount not exceeding
<br />One Thousand Dollars ($1,000.00).
<br />(9) To enter into contracts,
<br />agreements, leases, or stipulations.
<br />germane to the scope of its pow-
<br />ers and duties.
<br />(10) To let all work by contract
<br />or order it done by day labor, as
<br />the Board may determine.
<br />(11) To employ and appoint a
<br />Port Manager, who shall hold his
<br />position during the pleasure of
<br />the Board, and such other officers,
<br />employees and agents as may be
<br />necessary in the efficient and eco-
<br />nomical carrying out of its func-
<br />tions and to prescribe and fix
<br />their duties, authority and omn-
<br />pensation, and to require such of-
<br />ficers, employees and agents to
<br />give a bond in such an amount
<br />as the Board may require for the
<br />faithful discharge of their duties.
<br />All offices and places of employ-
<br />ment in the permanent service of
<br />the Board shall be created by or-
<br />dinance duly passed.
<br />(12) To provide and equip of-
<br />tices.
<br />(13) To expend all funds neces-
<br />sary to the carrying out of the
<br />powers and duties herein ex-
<br />pressed
<br />Section 48. HARBOR LANDS:
<br />All tidelands and submerged lands
<br />within the Port Area, whether
<br />filled or unfilled, now owned or
<br />hereafter acquired by the City of
<br />Redwood City, are hereby declared
<br />to be required for use for purposes
<br />in connection with. or for the pro-
<br />motion and accommodation of
<br />commerce, navigation or fishery,
<br />and shall,* except as herein pro-
<br />vided, continue to be withheld for
<br />such purposes. It shall be unlaw-
<br />ful to grant, sell, convey, aliepate,
<br />transfer or otherwise dispose of,
<br />except as herein provided, any
<br />part of or any interest in the
<br />waterfront, tidelands, submerged
<br />lands, or appurtenances thereto be-
<br />longing, owned, controlled, possess-
<br />ed or held by the City of Redwood
<br />City in the Port Area; provided
<br />that grants of such lands may be
<br />made to the State of California, or
<br />to the United States of America,
<br />for public purposes, when author-
<br />ized by a majority vote of the
<br />qualified voters of the city, vot-
<br />ing upon the question of author-
<br />izing any such grant at an elec-
<br />tion.
<br />Section 48a. LEASES: The Board
<br />shall not make or enter into any
<br />lease of any property belonging
<br />to or possessed by the City of
<br />Redwood City within the "Por
<br />Area" except in accordance with
<br />the manner, and subject to the
<br />provisions of Section 3, Subdivision
<br />18, of this Charter, and all power
<br />and duties therein imposed upon
<br />.the Council are hereby conferred
<br />and imposed upon the Board in re
<br />spect to property under its juris-
<br />diction, and, provided further, that
<br />all leases made shall be subject tc
<br />the referendum provisions of thh
<br />Charter.
<br />Section 48b. ANNUAL BUDGET
<br />The Board shall annually, on of
<br />before the third Monday of May
<br />carefully prepare a. budget setting
<br />forth the estimated receipts of thi
<br />port, and from other sources, fol
<br />the ensuing year, and the sum'
<br />of money necessarily required fol
<br />the administration of the depart
<br />ment, and for maintenance, oper
<br />ation, construction and develop
<br />meat of the port and its facilitie.:
<br />for the ensuing year, and statim
<br />the amount necessary to be raise(
<br />by tax levy for said purposes. Sai(

<br />City Council.
<br />Section 48f. WORKING CAPI-
<br />TAL: The Council shall appropri-
<br />ate One Thousand Dollars ($].-�
<br />000.00) to the Board for the fiscal
<br />year 19361937 which shall he un-
<br />der the jurisdiction and control
<br />of the Board as soon as it is
<br />legally constituted.
<br />Section 48g. DUTIES OF
<br />TREASURER: All moneys under
<br />the control of the Board shall be
<br />Immediately paid over to the
<br />Treasurer of the City of Redwood
<br />City, who shall have the care and
<br />custody of said funds, and shall
<br />keep separate accounts thereof,
<br />and pay out the same, as provided
<br />in this Charter.
<br />Sect iop 49: BUILDING PER-
<br />MIT$: No person or persons shall.
<br />construct, extend, alter, improve,
<br />erect, remodel or repair any pier,
<br />slip, basin, wharf, dock or other
<br />harbor structure, or any building
<br />or structure within the "Port
<br />Area' without first applying for
<br />and securing from the Board a
<br />permit so to do, in accordance
<br />with the rules and regulations
<br />adopted by it. In approving or de-
<br />nying the right to said permit, the
<br />Board shall Consider the appli-
<br />cation therefor, the character, na-
<br />ture and size and location of the
<br />proposed improvement, and exer-
<br />t tree a reasonable and sound discre-
<br />tion in the premises.
<br />Such permit shall be in addition
<br />to any permit which may be re-
<br />s quired by law from the Building
<br />Inspector of the City of Redwood
<br />Section 49a. CONTRACTS: All
<br />contracts, except where the ex-
<br />penditure involved does not C4 -

<br />Dollars ($500.00), shall be made
<br />and entered into upon competitive
<br />bidding in the manner and form
<br />as provided in Section 87 of this
<br />Charter, and all powers and duties
<br />therein conferred or imposed upon
<br />the City Council are, in relation
<br />to all matters connected with the
<br />port, hereby conferred and im-
<br />posed upon the Board, and all
<br />powers and duties therein con.
