And that said Charter of the City of Redwood City be amended by the addition thereto of new Sections to be numbered as follows, to -wit; Section 47, Section 47a, Section 47b, Section 47c, Section 47d, Section 47e, Section 47f, Section 47g, Section 47h, Section 48, Section 48a, Section 48b, lection 48c, Section 48d, Section 48e, Section 48f, Section 48g, Section 49, Section 49a, Section 49b, Section 49c, Section 49d, Section 49e, Section 50, Section 50a, and to read as follows, to -wit: Section 47. ESTABLISTIMENT OF A PORT DEPARTMENT: To promote and more definitely insure the comprehensive and adequate development of the Port of Red- wood City through continuity of control, management and opera- tion, there is hereby created a de- partment of the City of Redwood City to be known as the "Port Department" Section 47a. BOARD OF PORT I COMMISSIONERS: The exclusive control and management of the Port Department is hereby vested in the Board of Port Commission- ers, which shall be composed of five (5) members, who shall be ap- pointed by the City Manager, sub- ject to the approval of the Coun- cil. No person shall be appointed as a member of the Board who is -not at the time of his appointment, 'and has not been continuously for three (3) years immediately 'pre - :ceding, a qualified elector of the 'City of Redwood City. The members of the Board shall serve without salary or eompenaa- tion. Section 47b. ORGANIZATION; TERMS OF OFFICE: Within thir- ty (30) days after the ratification of this amendment by the Legis- lature, the City Manager shall ap- point five (5) persons as mem- bers of the first Board, subject to the approval of the Council. The members so appointed shall immediately organize by the elec- tion of a President, Vice -President and Secretary, and make provision for stated meetings, and shall de. termine, from time to time, when and where the Board shall hold Its meetings, which shall be open) to the public. Said persons shall, thereuponj also cast lots for their respective) terms: One (1) of whom shall serve until the first Monday of July,, 1938. Two (2) of whom shall serve' until the first Monday of July, 1940. Two (2) of whom shall serve until the first Monday of July, 1942. At the expiration of the term of each of said persons so ap- pointed, their successors shall be appointed by the City Manager, subject to the approval of the Council, for a full term of five (5) years, except in the case of a vacancy, in which event the appointment shall be for the un- expired term. Section 47c. REMOVAL: Any member of the Board may be re- moved from office on five -seventh (5/7) vote of, the whole Council. or by recall as provided in Sec- tion 0 of this Charter. Section 47d. (7) To fix all rates, dockage, rentals, tolls, pilotage, wharfage, and charges, for the use and oc- cupation of the public facilities or appliances of the port, and for services rendered by the Port De- partment, and to provide for the collection thereof. (9) to purchase materials and supplies without advertising for bids in an amount not exceeding One Thousand Dollars ($1,000.00). (9) To enter into contracts, agreements, leases, or stipulations. germane to the scope of its pow- ers and duties. (10) To let all work by contract or order it done by day labor, as the Board may determine. (11) To employ and appoint a Port Manager, who shall hold his position during the pleasure of the Board, and such other officers, employees and agents as may be necessary in the efficient and eco- nomical carrying out of its func- tions and to prescribe and fix their duties, authority and omn- pensation, and to require such of- ficers, employees and agents to give a bond in such an amount as the Board may require for the faithful discharge of their duties. All offices and places of employ- ment in the permanent service of the Board shall be created by or- dinance duly passed. (12) To provide and equip of- tices. (13) To expend all funds neces- sary to the carrying out of the powers and duties herein ex- pressed Section 48. HARBOR LANDS: All tidelands and submerged lands within the Port Area, whether filled or unfilled, now owned or hereafter acquired by the City of Redwood City, are hereby declared to be required for use for purposes in connection with. or for the pro- motion and accommodation of commerce, navigation or fishery, and shall,* except as herein pro- vided, continue to be withheld for such purposes. It shall be unlaw- ful to grant, sell, convey, aliepate, transfer or otherwise dispose of, except as herein provided, any part of or any interest in the waterfront, tidelands, submerged lands, or appurtenances thereto be- longing, owned, controlled, possess- ed or held by the City of Redwood City in the Port Area; provided that grants of such lands may be made to the State of California, or to the United States of America, for public purposes, when author- ized by a majority vote of the qualified voters of the city, vot- ing upon the question of author- izing any such grant at an elec- tion. Section 48a. LEASES: The Board shall not make or enter into any lease of any property belonging to or possessed by the City of Redwood City within the "Por Area" except in accordance with the manner, and subject to the provisions of Section 3, Subdivision 18, of this Charter, and all power and duties therein imposed upon .the Council are hereby conferred and imposed upon the Board in re spect to property under its juris- diction, and, provided further, that all leases made shall be subject tc the referendum provisions of thh Charter. Section 48b. ANNUAL BUDGET The Board shall annually, on of before the third Monday of May carefully prepare a. budget setting forth the estimated receipts of thi port, and from other sources, fol the ensuing year, and the sum' of money necessarily required fol the administration of the depart ment, and for maintenance, oper ation, construction and develop meat of the port and its facilitie.: for the ensuing year, and statim the amount necessary to be raise( by tax levy for said purposes. Section 48f. WORKING CAPI- TAL: The Council shall appropri- ate One Thousand Dollars ($].-� 000.00) to the Board for the fiscal year 19361937 which shall he un- der the jurisdiction and control of the Board as soon as it is legally constituted. Section 48g. DUTIES OF TREASURER: All moneys under the control of the Board shall be Immediately paid over to the Treasurer of the City of Redwood City, who shall have the care and custody of said funds, and shall keep separate accounts thereof, and pay out the same, as provided in this Charter. Sect iop 49: BUILDING PER- MIT$: No person or persons shall. construct, extend, alter, improve, erect, remodel or repair any pier, slip, basin, wharf, dock or other harbor structure, or any building or structure within the "Port Area' without first applying for and securing from the Board a permit so to do, in accordance with the rules and regulations adopted by it. In approving or de- nying the right to said permit, the Board shall Consider the appli- cation therefor, the character, na- ture and size and location of the proposed improvement, and exer- t tree a reasonable and sound discre- tion in the premises. Such permit shall be in addition to any permit which may be re- s quired by law from the Building Inspector of the City of Redwood Section 49a. CONTRACTS: All contracts, except where the ex- penditure involved does not C4 - Cecil the sum of Five Hundred Dollars ($500.00), shall be made and entered into upon competitive bidding in the manner and form as provided in Section 87 of this Charter, and all powers and duties therein conferred or imposed upon the City Council are, in relation to all matters connected with the port, hereby conferred and im- posed upon the Board, and all powers and duties therein con. £erred or imposed upon the City Manager are, in relation to all matters connected with the port. hereby conferred and imposed up on the Port Manager.
