<br />6 <br /> <br />Fire Safety Requirements <br />AB 2406 clarifies that a JADU is to be considered part of the single-family residence for the purposes of fire and <br />life protections ordinances and regulations, such as sprinklers and smoke detectors. The bill also requires life and <br />protection ordinances that affect single-family residences to be applied uniformly to all single-family residences, <br />regardless of the presence of a JADU. <br />JADUs and the RHNA <br />As part of the housing element portion of their general plan, local governments are required to identify sites with <br />appropriate zoning that will accommodate projected housing needs in their regional housing need allocation <br />(RHNA) and report on their progress pursuant to Government Code Section 65400. To credit a JADU toward the <br />RHNA, HCD and the Department of Finance (DOF) utilize the census definition of a h ousing unit which is fairly <br />flexible. Local government count units as part of reporting to DOF. JADUs meet these definitions and this bill <br />would allow cities and counties to earn credit toward meeting their RHNA allocations by permitting residents to <br />create less costly accessory units.
